AIN'T THAT THE TRUTH.

My fiance got denied entry I thoroughly believe because the officer was just bored and needed something to do.

So the solution.. Bring a nice sack lunch with you, a new board game or cross-word, and make sure to smile

May 2, 2006 - NOA1

June 1, 2006 - Transferred to CSC

June 14, 2006 - Notice from CSC it was transferred

June 30, 2006 - Received IMBRA RFE (CSC)

July 5, 2006 - Touched (RFE Received)

July 31, 2006 - APPROVED

August 5, 2006 Physical NOA2

August 15, 2006 NVC Received and Sent

August 22, 2006 AIT sent Packet 3

I don't believe there is anyway to get ahold of his status. I know you can write to USCIS and get a listing of the times he's crossed the border, but I doubt that will help you.

Truthfully, if you don't have anything in writing and it was just sorta an arbitrary number the officer threw out. I wouldn't worry TOO much about it. I mean, as a visitor he has 6 months by law to be in the country. I'm sure it'll come up in the interview (because the officer must write a report whenever they deny someone), but it doesn't really sound like a visa-deniable offense. And truthfully, probably the bigger thing you should be worried about is the fact that he was denied entry at all (you'll have some serious s'explaining to do, Lucy!) :)

Well, pretty much everything is arbitrary at the border. But I think this one might even been a little TOO arbitrary to be enforceable. They have to follow laws, and just picking a random time seems totally obnoxious. But, it IS the Border Patrol, and well, we alllll know how they can be.

How can the officer just pick a random amount of time and tell him that's his limit??

I have no idea....because i think they can just do whatever they want to do....

they didn't even change the date for his return flight....they just told him to do it himself....

they really are stupid....after they denied him entry and i had to later drive back through myself....they asked me if i had anyone else in the vehicle with me....like i was hiding him...and they i was told that they were just going to do a "random" search of my car.....silly people

then the same lady from the day before actually asked me what my fiance and i decided to do.....like we had many options at that time!!

I think they're just all crazy

The only wrinkle is that they took his fingerprints. I would send in an FBI request to see what is on his record: http://www.fbi.gov/hq/cjisd/fprequest.htm

If there is something to worry about, it will show up there. Either way, you have to be ready to talk about it at the interview, especially if it's on record due to the prints. Might be worth it to do a consultation with an experienced immigration attorney to be well educated and prepared.

Same thing happened to me, after Craig was denied entry, and I came back through after dropping him off, I got the same officer, and he asked me to get out of the car, tore apart my car, went through all my bags (didn't put anything back) and came thisclose to dropping my $3,000 laptop on the ground (he would have if I didn't put my hands under it to catch it before it hit the ground, and then he said, "Please don't touch anything ma'am.") He was a total jerk about it all. Telling me that I need to find another boyfriend because it won't be worth it. Grr. I'm getting mad just thinking about it!

No, I don't think it'll be that big of an issue. But he will most definitely have to explain the entire events of the denial at the interview (probably more than once) and convince the border that he didn't have immigrant intent. So it can be a little stressful (you aren't alone, Craig will be going throught he same ####### in his interview) but I think it'll turn out okay.

I mean it can't be that bad that he was denied entry....they did let him in a month later and just told him that he only had 30 days....when they let him through they knew that he still had a return flight for 3 months later....

really though he was trying to come into the country with the intent to EVENTUALLY get married.....but that was when we were kinda stupid and didn't have a clue about the process....just some false info. that we got from some lawyer....

If this is explained to them at the interview will it have a big impact on their decision?

From what you stated you didn't mean to do anything intentionally... And that is the key right there.. These guys that interview you interview many people a day and hear many lies.. I can guarantee you that .. they hear many.. and they can key onto this.. Just be honest and say... "Hey before we understood the process here is what we were gonna do, then we found out it was not the right way so he went back to canada. and that is why we started researching and following procedures, etc, etc, etc... "

Good advice. I've been denied twice at the border (and had fingerprints and been videotaped) so I need to know how to handle myself at the interview too. honesty is the best policy.
