HELP my I-130 sent to nvc before my I-129 arrived

Timeline

My I-130 petition got the NOA and a couple weeks later I sent the I-129 but when I sent it the same day I received the approval and the I-130 petition was sent to the NVC. Happened pretty fast. My question is is the visa being processed as a CR-1 or K3, since it was sent to the NVC before the I-129 was recieved? Any advice would be appreciated.

They are 2 COMPLETELY different visas and processed separately.

Forget the K3 and go all the way with the CR-1. K3s are obsolete at this time.

Forget the K3 and go all the way with the CR-1. K3s are obsolete at this time.

In this case there will be one case and one case only, because an I-129F for a spouse cannot be approved after the I-130 is approved. Your I-129F will be denied. Follow the CR1 guide.

Pushbrk, if that is true a I-129F will be denied if a I-130 is approved first, what happened in my case? My I-129F K3 was approved 2 days AFTER my I-130 petition? I too was surprised, but I got the email from USCIS Washington, DC followed by a phone call from them.

I don't know all the facts of your case but it would seem USCIS deemed the cases approved simultaneously. I suspect they were adjudicated together and the two-day difference in data entry was considered irrelevant. If not adjudicated together, then the approval of the I-129F would have occurred without direct knowledge the I-130 was no longer pending.

This is a case of filing the I-129F after the I-130 is already approved. The law says the I-129F cannot be approved.

You stated eveything happened fast, I am just wondering when did you send your I-130 and what date you received your approval.

I-130/I129f

6/14/2008 Sent to Chicago lockboxt

6/18/2008 received by USCIS

6//27/2008 NOA1

8/14/2009 upgarded the I-130 to immedi Reltive

8/25/2009 send I-129F

9/2/2009 NOA1 for I-129f received

9/10/2009 sent expedite request.

9/16/2009 first Touch since 6/27/2008

9/16 129f and I-130 Approved

9/22 Hard copies received

9/23/2009 NVC received my I29f/K3 still waiting for the I130

9/24 I29f sent to embassy

10/05 NVC case number assigned to my I-130

10/7 received DS3032 and AOS email

10/7 Sent DS-3032 by email and mail.

10/7 paid AOS

10/9/2009 AOS sent

10/9/2009 expedite request accepted, login failed, case sent to the Eabassy

11/22/2009 Interview

11/24/2009 Visa issued

11/29/2009 arrived to the US.

Search yourself if you don't believe me. Some things are common knowledge among those that know the process. We've had numerous reports here from people who had their I-129F denied for exactly that reason. Do a search of this forum if you like.

The applicable law is "The Life Act".
