Hi everyone, I am new to the website but I have been absorbing all the information you all have to share. We are waiting for our NOA2 for our fiance visa and since just waiting is too hard I have been doing all the research possible about the interview. I was just wondering if people have any information an/or opinions on whether it helps (in the interview) if you are going through the process with lawyers or if that doesn't seem to affect anything. Thanks for the help!

When it comes to K1 filing... if one has good reading comprehension.. it can be done without a lawyer and save money as well as, in many cases, time. If it is a complex case with numerous red flags.. a lawyer may be beneficial in resolving the issues...

Sadly, everyone is beyond help in the interview at the Guayaquil consulate unless they read the horror stories here and plan to overcome the very worst scenario that is conceivable. See the "Embassy Reviews" (link is atop every VJ page), and especially the "U.S. Consulate in Guayaquil, Ecuador" thread in the Latin American regional subforum (I'll bump the topic toward the top so that you can find it readily).

Do not believe the "easy" stories or any high ratings. Ignore this advice at your peril.

Depending upon how you may have "front-loaded" your I-129F petition package with "evidence of relationship," it could be a very good thing indeed if USCIS sends you an RFE (request for evidence) regarding anything that you may have missed. You can take such an opportunity to include information that USCIS will not care about, but the consulate will. Please stay in close touch here regarding your progress.

The above aside, please ensure that you have enough travel funds and vacation days to attend your fiance's first interview in Guayaquil, whenever it ends up being scheduled after your I-129F petition is approved. If you are not there, there is no prayer that he will be issued his visa... and the consulate will never tell you this.

As just a hint of what can lie ahead when dealing with the Guayaquil consulate, please read and heed the information in my "signature" below, beginning with 01-23-2008.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg

Sorry, but you didn't READ the OP's question in her post. Neither did the first respondent, in fact. The OP has filed and is awaiting the NOA2. Her timeline also reflects this. The fact that she posted in the "U.S. Consulate" forum and not in the K-1 forum is another clue.

Lawyers? Plural? As in more than one lawyer? Yikes. Lawyers do not go to interviews, how could it help? Save your money for your honey.

Thanks everyone for the help. I realize that it is not necessary to have lawyers but I was just wondering if people felt that it was an advantage in the process or not. And, yes, as T-Bone states we have already filed so I am more focused on the interview. Thanks for the advice though. And, T-Bone I have read the warnings about Guayaquil and am collecting as much information as I can while we wait. And there is no way that I wouldn't accompany him to the interview, I want to be there and already am in Ecuador so it shouldn't be a problem. Thanks again!

I have no idea if rules have change. But not so long ago, my fiance- now my husband- was not allowed in the interview. my case was simple I did not have problems and I only had one interview.

I have no idea if rules have change. But not so long ago, my fiance- now my husband- was not allowed in the interview. my case was simple I did not have problems and I only had one interview.
Yes, both have been there & been turned down. To my knowledge, the rules have not changed... nor will the consulate ever admit that the petitioner is required to be there. SM&LP were very lucky to have interviewed under whoever the previous consular regime was. It is premature to be hopeful, but another VJ couple just interviewed within the week (after having been rejected at Guayaquil, reaffirmed by USCIS, and reinterviewed in Guayaquil) and said (to me, privately) that they were treated as nicely as could be and were asked only ONE question. This could be because this was a re-interview mandated by USCIS, or a fluke, or (here's the hope) that the consular personnel and attitudes have changed. Do not count on this last, just yet.
