Anybody can give me an instruction on how to file a waiver? More details below;

This month would be my schedule to file I-751 but my husband walked away and not willing to provide any kind of documents to file jointly. We are both serving in US Army Goverment outside United States.Since, my husband is not cooperating of anything I was thinking to file a waiver base on extreme cruetly and hardship. My question, what documents do I need to submit? The documents that on my hand are company benefits with his name on beneficiary, LOA, two people affidavits and my company contract. Do you thing these documents are enough? and what is the best explanation to write for the extreme cruetly and hardship? Thanks in advance.

I don't have an answer for you sunshine but i believe there is a forum here about waivers. You might be able to get an answer or maybe someone hear from MENA can help. (crossing my fingers for you) Wishing you the best of luck!

happy friday

somethings going down at work again :( I realized yesterday that there is no scedule for next week :huh: ..i have a scedule thru..well,,tommorrow. Either they are closing up or downsizing again today. I am just sick to my stomach. I'm heading in now for the weekly Friday morning meeting. I think I'm gonna be sick.

Morning MENA..super happy that it is a long weekend and we get to leave work 2 hours early today. :dance: During the week I have made sure the house stays rather clean and clothes are washed so we can just relax. I booked another wedding photo shoot yesterday and I am happy about that. I hope this weekend we can work on business cards and flyers and try to get my photography "hobby" off the ground and make some extra cash!

09/13/2011 went to congressman's office to sign papers for expedite of work permit, due to financial hardship

09/15/2011 Work permit expedite approved!! He can finally find a job!

09/24/2011 work permit arrives

09/26/2011 Apply for social security number!

09/30/2011 Letter is sent for interview

11/07/2011 INTERVIEW!!!

Its 2012 and still no approval! Still waiting

01/27/2012 Letter sent stating that file was sent on for more review :(

I see you posted in the Removing Conditions forum. That's the best place to get answers to your questions. In order to file a successful waiver based on abuse, you will need documentation of that abuse. It sounds like maybe you were not the victim of abuse per se, but instead the issue is that you are not yet divorced, but he won't provide you with the documents you need to file on your own. You will have a tough time proving extreme cruelty if it did not occur. A hardship waiver, however, might buy you some time to get a divorce complete so that you could file on your own.

I believe you will need to get divorce proceedings started ASAP if you want to remove conditions successfully.
