Do I need a co-sponsor?

Hi. I am brand new here and need some help. I am engaged to a wonderful man from Jamaica. My I-129 was approved and I have received the packet of forms from the embassy in Jamaica. My question is about the affidavit of support. I have four children plus myself living in my household and i realize I add my fiance as the 6th member. I only made 14,890 dollars last year on my w-2, however, I receive 24,000 dollars a year in child support as evidenced by my divorce decree, receipts of direct deposit from the state, and my bank account. If I can include my child support than I am over the cut off for the 2009 guidelines of 125% of the poverty line by a little over a thousand dollars. Will they accept child support in considering my income even though child support is not listed on my tax return as it is non taxable income? If not, then does my co sponsor have to make above the guidelines? My sister will do it but she is married and although the income of herself and her husband is well above the guidelines for three, her salary alone is just under the guideline for three. Please help!! I am worrying myself sick over this!! Thank you!!

I have heard that they will count court ordered child support but it has to have longevity and by that I mean it doesn't stop getting paid in the next few years. You would have to document it thoroughly. I am sure that it is also gonna be consulate specific so you would need to do some research about the consulate you will be going through.

As for cosponsor, your sisters income needs to cover, her and your fiance not you if you are counting yourself as the third person. Does your sister have any children? This also would need to be documented with her tax forms and w-2's.

Thank you for your response! My sister is married so I was counting her husband, herself and my fiance...she has no children.

I forgot to add...the child support is in effect at that amount until 2013. This is documented in my divorce decree. I have proof that I have been receiving this amount since May of 2007.

We had our interview on November 18th, 2009 and we were APPROVED!!!

I am pretty sure if she has her own income she will not need to count husband in the household count. You might wanna check me on this one.

Another option available to me is my mother....she is retired as a teacher....gets enough in pension and social security to meet the minimum...plus owns a home, vacation home, cars, boats. etc....however she would not have a "job letter" obviously....

Those tables are from 2008. The tables for 2009 are in the latest I-864P:

125% of the poverty level for a household of 6 is $36,912. Her income, including child support, is $38,890. Like she said, she makes it by a little less than $2K.

Where do you come up the "additional person"? A household size of 6 includes herself, her four kids, and her fiance.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Your sister wouldn't have to include her husband in the household size calculation. She would need enough income to cover herself and your fiance.

Does anyone know if I can use a co-sponsor who is already sponsoring someone else?

My mom is my step-dad's sponsor, but I was also looking at her to be the co-sponsor for my fiance. My step-dad has been here for 8 years now and he's currently employed, so I don't think it should be a problem but I was wondering if there's any issue.

As long as they income is there it should not be a problem, there are questions on the forms about sponsoring someone else.
