If a couple has been together less than two years is there any benefit to applying for the CR-1 since it is going to come with conditions anyway?

If you go for K-3, you will have to spend extra money ($1010 I think) for AOS. Plus you can neither work till you get EAD nor leave the US till you get AP.

The benefits of CR-1 are IV serving as a temp I-551, work authorized, and immediate GC issuance.

Hi natay.

Yes, there will be conditions on the CR1, but at least your SO can hit the ground running upon arriving in the U.S. No need to apply for Adjustment of Status, EAD nor AP, since your SO will be a LPR (green card holder), albeit conditional. If your SO finds a job, then s/he can start working...there would be little to no downtime, depending on what kind of job your SO wants to pursue. Before the CR1 expires, your SO would have to apply for Lifting of Conditions.

You will need the US$ 400 IV fee (for each intending immigrant) when you are at the NVC stage...which is roughly 2 to 4 weeks from the time you receive your NOA2 for the I-130. Plus your SO needs to get all the documents together for NVC processing.

From this point forward, the costs are appx. as follows:

For CR1 appx. $470 paid to NVC. After marriage is 2 years old, another $455 goes to USCIS to remove conditions.

For K-3, $100+ to Embassy/Consulate. Then you enter the U.S. with the K3 visa and wait until the marriage is two years old (make sure K3 stays valid until then), and then spend $1000 to do an Adjustment of Status. This will result in a 10 year Greencard with no need for removing conditions (saving the $455). So long story short, CR1 appx. cost is $900+. K3 appx. cost is $1100. K3 usually gives 3-4 weeks of overall time advantage in most cases.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
