I called from Syria to the USCIS and just got off of the phone with a very rude

woman at the USCIS about my case. Here is the whole details..........I

had a woman helping us to get my husbands visa and we got his interview

it was set up for Jan. 07, 2009. This was after she had caused us a

years delay due to her not mailing our case before the rates went up.

When his interview came due she told us not to bring any proof to the

interview that he would be given a second interview to show proof. Well

the consular was also rude made racist remarks to my husband and when he

tried to explain what happen and that he could have the proof faxed to

the office immediately all the man said was no, visa is denied, he was

sending it back to NVC and then to the USCIS and they would contact me

(the petitioner) for additional proof. I have contacted the embassy

immediately after and also had an immigration lawyer to contact the

embassy to try to get my husband another interview (a fair interview),

to prove our marriage is bona fide. Both of us was denied this

opportunity and was told it had went back to the states. I also know it

had to go thru the supervisors hands before being sent back. The USCIS

did not receive it until the 23rd of march so we could have gotten this

interview reinstated at the consulate level.

However we have been denied a fair interview and it is back in the

states and at this point we have not gotten any letters or emails

regarding our case. I called and was told that I would get an answer in

120 days from March 23rd. and waited patiently the 120 days only to be

told it would be 2 to 4 more weeks and they would send us a letter

telling us the decision. It has now been more than 6 weeks without no

letter, no call, nothing. I have however called to find out why I have

not gotten a letter and this is what the woman at USCIS told

me.......the case was reaffirmed and sent to the Dept. of State and was

re-denied and sent back where it now sets to be just buried. I want to

know why I have never been contacted and given the chance to show all

the proof that I have. I have been married to my husband now for almost 3

years and I want to know why it is thought that our marriage is not

real?!

The woman said to contact the NVC and try to get my proof sent in. All I

ask is that we get our chance for a FAIR interview. I have proof out the

wazoo! My question is why have we not recieved a response from the uscis or nvc to prove our marriage is bona fide???

Also I would like you to know that I left the states to be with my husband because USCIS said we would have an answer by 120 days. I have left my job and sold everything I own just to be here and now because of this I may have to come back to the U.S. without a job, without a place to live, AND WITHOUT MY HUSBAND!!!!

They are playing God with so many peoples lives here and yet we have all the illegals flooding our country and being welcomed with open arms!

Both me and my husband are at wits end and do not know what to do next.

HELP!!!!!!!!!!!

First have you tried an info pass appointment at your local office?

Second have you contacted your state representative to get them to handle your immigration case and get some answers for you?

Third have you read through the pinned 221g rejection thread yet for other ideas and contact with those who have also gone through what you are going through now?

If she is overseas with her husband where would she get an infopass appointment at. I would give Marc Ellis a call or email and see what he says. I think he is one of the best in this type of case.

This will not be over quickly. You will not enjoy this.

Im sorry to hear what you are having to endure. I can only imagine how you must hurt now and confused as to why this is happening. I wish I had some good advice for you however this process is new to me, and so I really cant offer much except my support. I realise you are out of the country, but I would contact the representative of the state that you did reside in here and maybe begin there. I wish you all the best of luck!! (((((HUGS!)))))

I sent you a PM with some information earlier today. It's a lot of info to take in while stressing about what is happening I know. Read through it and let me know if you have any questions, I'm happy to help you make some sense of it.

While all cases are different, yours really is different from those I am familiar with since after reaffirmation the consulate did not provide an opportunity for a new interview, and you have gotten no written documentation from the USCIS.

I would definitely contact my sentate/congressional rep as well as speak to an immigration lawyer who can prove they have experience in this area of family immigration.

Once everything is denied and "buried" are you allowed to refile again?

Are you in Syria now? Can't you refile via DCF? At least if you have to start over, it will be much faster than going through USCIS. Did you do a K3 or a CR-1/IR-1 petition? Maybe you can do the other if one was already denied.

Not sure with the details of yoru case and all, but just throwing ideas out there????

Sent in I-130 form: 01/29/09

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

Can't do info pass cause I am in Syria. I have contacted everyone I could think of from the trash man to President Obama. Hopefully I haven't forgotten anyone. I have been reading all the information I can and see that I do need legal help.

I am in Syria now and am working on getting my permanent residency, but it is a long process. I filed the K-3 / I-130. We have contacted Senators and State Reps and are now awaiting for what they can find out.

Appeal then refile, or have senator go after on a FOIA. EVeRY one deserves thier day and to be heard, what a bunch of commies over there wow!! and this folks is the US embassy.

august 2004 I-129 filed (neb)

DEC 2004 Approved

interview: SEOUL

MArch 21st , 2005AR for special security clearance,washington

May 18th tranfer case from Seoul to Islammabad

June 21st security clearance done

June 28th online at the embassy in Islamabad

waiting for paper transfer and the good word

OCTOBER 14TH 2005 Interview Number 2: ISLAMABAD, PK

AR number 2 sent to DOS per Islamabad (2 cable request)

Nov 22 okd updated financial and etc proof accepted / embassy waiting for security cables

dec 20th one cable back waiting on 2nd

Jan 17th.. good word recieved. SECURITY CHECKS ALL CLEAR!!! DOS says embassy to contact him within two weeks!!!!!!

FEBRUARY 10th, 2006 VISA RECIEVED!!! They called him In via phone, stamped his passort and sent him on his way!!!

FEB 28th WELCOME HOME>>>POE CHICAGO did not even look at xray, few questions. one hour wait at Poe

march 10th marriage (nikkah at the islamic center)

aug 2006 AOS interview, cond 2 yr GC arrived september

June 2008 applied for removal of conditions on permant residency aka awaiting for 10 yr greencard

Dec 2008 10yr green card approved, no interview.
