Leave US after get married

Timeline

What will be?

If I leave US just after get married, before I get status adjustment finished?

We are planing to have the wedding during Christmas there, and we want to come back for Spring Festival here in China. But that is on 14 Feb. Obviously we don't have enough time to finish my status adjustment.

Whether I will be refused to entry US again after the spring festival if I just leave like that?

Or whether my husband (at that time) could go back first to get my temporary green card and mail to me, then I could enter US again?

Our timeline:

2 April, Send I129 petition

7 April, Got phone call, asked for some other documents.

24 May, See NOA1 online.

6 June, Received paper P1

21 Aug, See approval on website.

28 Aug, received paper P2.

31 Aug NVC mailed out to consulate.

18 Sep, Get phone call from consulate, confirm about mailing address.

25 Sep, received P3.

25 Sep, Send back P3.

28 SeP, Consulate received P3.

20 Oct, call DOS and got interview date: 19Nov

25 Oct, P4 received.

3 Nov, Medical Check

11 Nov, Medical Check Report Received and pick up my bf in airport.

16 Nov, My bf attend petitionor hour in consulate

19 Nov, Interview approved.

22 Nov, Visa package arrived.

7 Dec, Fly with my bf together back to US.

If you leave the US without AP/Advance Parole (at least), you will not be permitted to re-enter the US and will end up having to file again, only this time for a spousal visa.

You would need to file for AOS (along with the AP and EAD) as soon as possible after you're married.

If I leave US just after get married, before I get status adjustment finished? If you do this it will indicate to the USCIS that you are abandoning your status. You can leave...but you cannot return and your spouse would have to reapply for you with a spouse visa. You really do need to read the guides about K-1 Visas.

It might be possible to get Advanced Parole approved in time. Just maybe though...can't promise that.

You will be refused entry UNLESS you have your Advanced Parole document IN HAND when you enter the U.S. again. That is the ONLY way you can come back before your AOS is approved. You have to indicate you want this when you apply for AOS...it's all included with the price.

Not sure what they are running now, but when my husband adjusted status his approval took 10 months. Just sayin'.

Thank you very much for your advices. In fact, that's what I think. But my bf seems doesn't believe although he never learn and do research on this K1 visa issue. Now I will let him come to read this, to give him the proof.
