My name is Xiao, I'm petitioner for my wife in China, My I-130 application has been approved, I received E-mail from the NVC that regarding the DS-3032 form and AOS fee, I already paid the $70, and I will return the DS-3032 ASAP. I have mailed I-129F application today for a K-3 VISA.Unfortunately I have apply for a K-1 VISA last year, it was rejected by Jan 21 2009. My question below:

1, Does the K-1 rejection will bother the CR-1 and K-3 process and interview.

2, How long could take between AOS fee paid and interview for CR-1. The K-3 and CR-1 visa which is faster to set a interview from now on. if K-3 interview is early, have to take second time the medical examination and injection for CR-1?

3, what I have to do with I-864 form. be honest, I don't reach the requirement of the Immigration.I'm full time college student, unemployed, got lay off last year, all my income for now is unemploy benefit,I own a 1500 Sq feet Condo with paid off worth 129,000 dollar.I also own a car worth 7,000 dollar. can I get someone else to help me, such as my mother and her boyfriend. My mother's income does not reach the line either, but she owns two properties, one is same as mine and in the same community, another one is a mobile home cost 20,000 dollar. Her boyfriend currently unemployed, but he made over 100,000 per year before last september, and he gets unemploy benefits as well, over 2,400 dollar per month.

4,Should I hire a attorney or just do it all by myself.

Thank you for your help

Yes it will unless you can correct why they denied the K1.

Hire a attorney!

Looks like you are lacking financially also.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Your I130 has already been approved - you are not eligible for the K3.

Wrong!

Hasn't been approved by the embassy yet. He can still go with either one or both.

Once an I-130 is approved, an I-129F cannot be later approved, because a prerequisite for approving an I-129F is a "pending" I-130. Once the I-130 is approved, it's no longer pending.

From the K3 forum. Unless I am reading the OP wrong, he stated that the I130 was approved and he JUST sent the I129F today, after approval.

Montreal: BEAT!!! Approved!!!!!
