Dilemma on when to file I-751.

Hello Ladies and Gents,

I have a bit of dilemma here. My conditional green card will be expired on November 20th. Before realizing my Green card is going to expire soon, I went a head and booked flight tickets for me and my family to go back to Asia. The trip is from October 1st - October 18.

Now the problem is it states on I-751 that "you must file it during the 90 days immediately before the second anniversary of the date you were accorded conditional resident status." Does it mean I can file anytime within this 90 days before it expired? I am worry if I file it on October 19th, the extension letter will not come on time and I will be out of status by November 20th.

Another option is maybe I can file it on August 20th and hoping to receive the extension letter before my trip. But the problem is I am afraid they asked us for an interview while we are abroad.

You can file anytime within that 90 day window. If you come back home on October 18; your green card will still be valid.

Agreed... if your greencard expires in Nov and you will be returning in Oct you do not need an extension letter.

Guys,

Thank You for the prompt responds. I am glad to hear I don't have to cancel my trip since the tickets are not refundable. Another question that I have is how many of you that use attorney to file I-751? I used attorney to file my initial Green Card and I think my previous attorney does not worth the money. They didn't even show up during the interview.

You do not need a lawyer to file for removal of conditions. it is a simple form to complete and all you need is to collect the evidence together and photocopy it. Use the guides here on VJ.

hey shamu, u can fly without any difficulty....but make sure u file ur I-751 at that time within 90 days of ur gc expired so that u didn't miss ur biometric appointment. i mean plz avoid ur vacation n biometric appointment from being collide. as then u have to reschedule ur appointment which in turn will take processing of ur case long. so keep that in ur mind before filing.

I would file a few days before your trip. You should receive your 1 year extension letter while you are gone and then receive your Biometric appointment letter after you return. If you send it the end of end of August, you may miss your Biometric appointment. Just my thought.

You may send it the end of August and receive your apointment before you go on your trip, but that may be a little risky in case you are gone when it arrives. Your choice. Look at other's Timelines and see how they were scheduled.

Much appreciate with your advices. I think I will file couple days before my trip... according to other timelines, the bio appt letter should arrive roughly 1 to 11/2 months from the filing date.

Ahhh now I know how you guys put these timelines in the signature. I thought wow it is so cool that everybody have the same template for it haha.. I will have to dig out all my paperwork to remember all the dates :D. Will do that tonight or this week...

Not just the timeline in your signature, but your VJ timeline. Follow the directions above and it's really easy. Have fun on your trip! I'm sure we'll see you on the boards when you are closer to filing, and after you return :)

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing
