questions about co-sponsor

This is my problem, I have not worked in over 12 years I was married before and was a stay at home mom to my 3 children. And then I divorced and started going back to college so still I didnt work. I do have a job and am renting a place to live now. But I do not meet the income requirements nor do I have any tax returns to show any prove of income. . Therefore I have no income at this time to support my spouse but I know I must still fill out the I-864. These are my questions:

1. If my spouse and I and my 3 children decide to live with my mother and father and my father co-sponsors for my spouse then my father must fill out the I-864A and must make enough money for a household size of 7 people is this correct?

2. If we decide not to live with my mother and father and we continue to stay in the place I am renting now, but I still have my father co-sponsor my husband what would be the household size then? Would my father still need to make enough money for 7 people or would it be just 3 people my mother and father and my spouse and my father would need to fill out the I-864 not the I-864A?

3. If we get a sponsor that is not a family member and we are NOT living with him in his home what would he add for the household size? and can this sponsor live in a different state?

It just seems like the more people in the household the more money my co-sponsors must make so Im just confused if the co-sponsors must add my spouse, myself and my 3 kids as household size if they are sponsoring my spouse but we are not living with them in their home.

You have no income so living in the sam house with your parents or not will have no bearing unless your parents would then claim you and your kids as dependents.

Your household size (based on what you have said) is 5.

Co-sponsor household is number of dependents on last tax return plus 1 for your husband. You and your USC children are not being sponsored.

Co-sponsor can be any USC or LPR.

So if we do or we do not live with my parents they will only claim my husband in their household size so it would be my mother, father, and my husband so 3 in household size and even if I have no income and we live or do not live with my parents I will put 5 as my household size me, my husband and my 3 kids? My parents never have and will not claim me or my kids as dependents on their income tax. Im sorry I know I must sound very stupid but I am just so confused please someone help me clear all this up.

You MUST submit an I-864 even with no income. Plus if you have not filed tax returns for the any of the last 3 years you must submit a written explination of why you were not required (see page 8 of the I-864 instructions).

Co-sponsor household is number of dependents on last tax return plus 1 for your husband.

Any co-sponsor must count in their household size all the dependents claimed on their last tax return PLUS your husband. If your parents are combining incomes one will complete and I-864 and the other will complete an I-864A.

Ok thank you so much I think I am finally starting to understand SOME. Any co-sponsor that we get will base their household size on the co-sponsor, any dependents that are on the co-sponsor tax return, and my spouse am I correct on this? But what still confuses me is if we live with my parents my father will fill out the I-864A (contract between sponsor and household member) and I have no income will my father have to put me and my children down as household size as well. For example me, my spouse, my 3 kids are living in my mom and dad's home with them and my father fills out the I-864A contract will he base his household size income on all 7 of us in the home or still just would be mom and dad and my spouse. I believe someone told me that its based on ANYONE that lives in the home so my father would have to base the household size on ALL that are in the home ex. me and my kids. That is why I am so confused.

Dad will do an I-864 and stand on his own income. If Mom and Dad combine income then Dad does the I-864 and Mom does the I-864A to combine her income with Dad's (or vice versa). If you and your kids are not taken as deductions on the most recent tax return then you would not be counted in the household size.
