To all VJ members,

Me and my husband were married last feb2008. We had a child who is 18 months old now. Last Sept,2008 we found out that he's having a cancer so i sent him back here in US for treatment. At that time im still in the Philippines and trying to get my visa. Last May14,2009 my daughter and i arrived here in US. But sad to say my husband passed away last month(July28,2009).

Its not easy to be a single mom,to be alone by now and not be with my husband whom i depend too much.I appliedd for survivor benefits from social security. With that money i decided to moved back in the Philippines BUT SSA said that if il go back in Phil and stay there for more than 6 months our pension will gonna stop.

Also im thingking all the time about my situation here,about my conditional status because im a cr1 while my daughter is having a 10 yrs greencard.

Pls advice me what to do with my status. Since my husband is gone,what will be happen in my conditional status?Should i need to lift it?

I am planning to go back also in Phil next month.

Advice will be highly appreciated.

hey u can remove the coditions on ur own without ur husband . i dont think u will have any problem with that. after that u will be given the 10 years green card. u can visit the philippines but dont stay long so u can keep getting the social security. i am so sorry for ur loss. good luck with everything.

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. Really sorry about your loss...

however, you can life conditions on your own, and definately don't stay in US for too long...

Simply go if you really have to otherwise, your best bet is to do what you can here.

File the I-751 as soon as you can and get your 10 year GC before you go anywhere.

Why isn't your anak a US citizen?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

condolence yan...i wish your okay and your baby...i know its hard to be alone especially away from family.

just try to lift condition even your alone...i guess your hubby is an angel to you...he brought you here so it means he wants you to have a good life here and your baby...though it'll be hard being alone and single mom...but your hubby will always help you...maybe not physically being there but in some other ways.

can i remove my condition at any time now?it will be expired on 2011.

how i wish i cud stay back in phil next month,i miss my family there.

i was already giving up my residency here but SSA changed my mind. I need that money for my daughters future.

My daughter is not usc because shes my anak from another man. But my husband wanted to be the father of mu child,he was there when i gave birth to my child,he gave his last name to my child. My husband was more than a biological father to my anak.

Pag mag apply ng removal of condition, it has to be 90 days before expiration ng greencard. You may file ng mag-isa, basta totoo ang relationship nyo ng asawa mo, no problem. Kailangan lang patunayan na nung mga oras na andyan pa cya, nagspend time kayo together, mga papeles na magpapatunay na mag-asawa kayo like bank account statements, lease agreement, car insurance, medical insurance, etc... basta mga proof na bonafide relationship nyo.

K-1 Visa Application:

June 30, 2005- Sent I-129F

July 12, 2005- Processing Date

September 16, 2005- I-129F Approval Notice

September 29, 2005- Approval Notice sent to US Embassy in the Philippines

January 26, 2006- US Embassy sent Medical and Visa Appointment dates

March 2, 2006- Medical Appointment

March 9, 2006- Visa Interview

March 21, 2006- Visa received

March 24, 2006- Attended CFO Seminar in Q.C.

March 28, 2006- Flight to the USA

Marriage:

May 1, 2006- Applied for Marriage License

May 20, 2006- Got married in Chandler, Arizona

July 24, 2006- I-485/I-765 sent to USCIS

July 31, 2006- Processing Date

August 2, 2006- USCIS sent a Biometrics Appointment Letter

A few things,, Contact you Senator and Congressman,,, see which one has a better immigration support person. And, see what they have to say about your situation. Also, get an appointment with Immigation to see what they have to say. There has been some changes to the law in regards to spouses in your situation.

Always validate the information you are given,,, and get it in writing if possible.

I think you will need to stay in the USA if you need the income and more importantly,,, you will give up the pathway to US citizenship for you and your child.

If you have any relatives in the USA to help you... Might be a good time to call... cause,,, with survivor benefits you would not be a financial burden to them,,, and

who knows in this current recession. Might even be welcome.

Sorry for your loss, Give it some time. The days ahead will get better.

I am sorry for your loss.. that's a really hard situation,your husband is gone. I hope you stay strong. Pray and be a strong mother..

I don't know what advice I can give on your citizenship question. you might get more answers here from VJ or call USCIS.

You can file the I-751 now. I know someone that was is the same situation as you. They filed and was granted the 10 year GC without an interview.

To Haole: thanks so much for spending time to searched that topic.I really appreciate it.

For everybody:

I talked to my lawyer this morning and he said i can file for removal anytime since my husband passed away. He told me i can go back in the philippines next month without having a problem for coming back here. Just i need to stay in Phi not more than 5 months. We talked about im going to stay in Philippines and stay there for 3-4 months,learn to drive in there and then come back here and file for removal. Then the next time i come back here i should stay longer and get the citizenship,sending my anak in school. I know God and my hubby are always at my side.

For now,I had no money and im staying in my husband's son and depending on him right now. He's been good to me and to my daughter. I hope by the last week of this month i can get the money from SSA so i can move on and buy some things for us.

I am 21 yrs old,had 18months old wiggily baby and dont know how to drive. But i stoll thank to God that i had someone i can depend on now and thats the son of my husband. I am hoping that he will never get tired of us.

I had a plane ticket already for coming back to phi. I purchased a round trip ticket.
