Hi Folks,

I received a notice from USCIS reminding me of the period within which to file my I-756(ROC). Is it the case that one will be notified as to when to file for N-400 when the time is due by USCIS?

Your usual response is very much appreciated.

No, they will not remind you. While Removing Conditions is required, Citizenship is optional, so once you become eligible, there is no timeframe within which you will have to file.

jsnearline is completely correct. And furthermore, even if they wanted to tell you when to file, they have no way of knowing for certain when you become eligible. Sure, their records can tell them how long you've held your green card, but, for example, if you stopped living with your spouse two and a half years after you got your green card, they probably wouldn't be aware of that, and that would change your required continuous residence time from three years to five years. And they certainly wouldn't know when you'd know enough to pass the English and Civics requirements. I suspect they don't keep really close track of how many days you spend inside and outside the US, especially if you're just crossing over into Canada or Mexico, since the US has no exit controls.

So it's up to you to figure out when you're eligible, and to file if you wish. Once you become eligible, your eligibility doesn't expire. It is possible that you could do something (like take a long trip outside the US, or commit a serious crime) which would make you become ineligible. But most people will remain eligible to file for a very very long time. I have a friend who've been eligible for citizenship for more than 20 years.

Notification from the USCIS even in such matters as your green card is soon to be expired? You have got to be kidding.

The only notification I am aware of is, your employer says you can't work here anymore, DMV won't renew your drivers' license, and if you happen to leave the country that you can do, they won't let you come back. So made a big sign on my refrigerator door as a reminder that I got sick looking at after 21 months. Didn't need a reminder for the N-400, heard once that is done, you are free from the USCIS. Also reminders to send in forms, two of them, in case we moved.

IRS doesn't send you reminders either, they are looking for the opportunity to either fine or imprison you and if you fail to pay your property taxes, find that you and your possessions are out in the street. But the draft broad sure found me after I turned 18.
