I have a question about the Affidavit of Support. What is the difference between the I-864 and the I-864A. I am the petitioner and the sponsor and I know I need to fill out the I-864 however, I have not worked so I dont have any income so my mother will be a co-sponsor and Im not sure if she fills out the I-864 or the I-864A. Im just not sure of the difference in this forms. Thanks.

864a is used by members of the same household.

864 is for everyone else.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

This may pose a problem with no income, how are you going to support the beneficiary in the future?

Thank you for your reply. So if we are living with my mother she will need to fill out the I-864A and any other joint sponsor that we may get, that we are NOT living with needs to fill out the I-864? If we are not living with this joint sponsor why must they still add us to their household size? Also my husband and I will be living in Michigan is it acceptable to get a joint sponsor for my husband from a family friend that lives in New Jersey? Thank you so much.

This may pose a problem with no income, how are you going to support the beneficiary in the future?

I was married for 13 years and was a stay at home mom and didnt need to work and then I divorced and for the past 2 years I have been going to college to better my education so I am able to get a good job. My beneficiary (my husband) when he comes to the US will find his own work also so we will support each other.
