can i apply for citizenship also after 2yr and nine month even if i am legaly separated but not divorce???

Do not believe you can, want you living and paying bills and taxes together. If you claim you are living together and they find out you are not, can be big problems for you. Better to wait another couple of years.

No you can't.

For at least 3 years during which time you have been, and

continue to be, married to and living in a marriage relationship

with your U.S. citizen spouse; or

Your short of the time required (2 years, 9 months) and being seperated is not a "marriage relationship".

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You cannot naturalize under the three year rule if you are separated for reasons other than circumstances that are truly beyond your control, such as economic necesity, military deployment, etc... A legal separation would make you ineligible. You will have to wait until you have been a permanent resident for five years.
