Got the I-797C for I-130 (applying for K3 visa)

Hello there. Can anyone help me??? My husband got the I-797C from I-130 that we send. Although it's not been approved yet. Can I send the I-129F now? I'm really confused right now because I'm trying to follow the steps/guide for K3 here in VJ and its says there that once you got the NOA1 for I-130, I can prepare the packet for I-129F which I did so that I can send it right away. Do I have to send it to the same address where we send the I-130? or follow the address according to the I-797C that we got for I-130? Please help me because we don't want to make mistakes and we also don't want to loose the I-129F if we send it without the I-130 being approved because I read from one post that they lost the I-129F when they send it to a different address because they are waiting for NOA2 of I-130. Please please help me! And for those who replied thank you so much! We want to send the I-129F asap. We don't want to waste time but of course we also have to be careful so if anyone can give me answers if I can send it, are we good to go or just have to wait for NOA2 for the I-130 that we send? Thank you... PLEASE READ MY POST...

DO NOT apply for the K3 it slows down your I-130 and it cost alot more in the long run.... don't do it ask anyone on VJ the K3 only brings your spouse only maybe a few weeks earlier than the I-130 and with the I-130 your spouse will get a green card and social security card and don't have to file for adjustment, with K3 you have to pay almost $1,000 to get an adjustment and approval to work and etc....

K3 is obsolete. Follow the CR1 guide. Don't file an I-129F.

If you ignore that advice, then yes, you send the I-129F as soon as you have the first I-797C for the I-130 and to the address from which the notice came. But please don't do it. If you do, you'll be wishing you never had.

05-01-2014 Got the 2 case numbers. (21 days)


05-07-2014 Got an email & paid the AOS fee (4 days); DS-261(Choice of Agent) sent


05-09-2014 AOS status "PAID" (2 days from the date the was paid)


05-22-2014 AOS docs delivered in NVC


06-27-2014 RFE for I864 and I864A (i left the Place of residence blank, 26 days from the date they received the AOS)


06-28-2014 Mailed the corrected forms to NVC

its obsolete in the sense that its not doing what it's supposed to

they are basically being approved at the same time as the I130's....and that's after waiting 4 and 5 months

after waiting that long, one may as well just go the CR1 route and forget K3, less expensive plus more benefits immediately = more bang for your buck

I864 delivered November 2nd.....nvc logged it on November 5th

DS230 delivered November 6th.....nvc logged it on November 12th

they are basically being approved at the same time as the I130's....and that's after waiting 4 and 5 months

but the one who posted this wants the k3 since they want to be together as soon as possible & less paperworks...its still upto them
