question.... please help!!

hey guys... my wife is under k1 status. we got married soon after she arrived (around early july). i was in the middle of filing for her green card but it turns out, she's not completely vaccinated. she has to get the measles vaccine and chickenpox vaccine as well as the tetanus, and that takes (i think) 2 initial shots, and then a third shot 6 months later.

her i-94 card says she's a k1 immigrant until september 20th of 2009.

so the question is, i can't even apply for the green card until after all the vaccinations are done, correct?

and if i wait until all the vaccinations are done, it'll be way past september 20th.

so what can we do?

another question.... i've been trying to talk to a representative from uscis or even from the US embassy to answer some questions but i keep getting sent to the automated voice message machine... is there a direct number i can call to talk w/ an actual person?

If you wait, then she will be out of status, which could cause problems with ICE - so try to get them done prior to the I-94 expiring.

If you send it in now, then you will probably get and RFE for the vaccinations, but you will usually get the NOA (which protects her status).

Your choice.

Keep calling USCIS - hit 0 till you are talking to a person. consulates usually communicate via email in my experience.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

i see... so just go ahead and submit what the i-485, and they will send me a NOA? and then just wait.... patiently?

Did she not have a medical and get the needed vaccines before she was issued the K-1 visa? If she is missing the necessary vaccines, an immigration medical exam will be needed, performed by a Civil Surgeon. You can check on the USCIS website for a list of Civil Surgeons in your geographic area and contact them.

That is one choice, yes. (however, you are gambling that they accept the application without the vaccination sheet, and will just send you and RFE, not send the whole package back (without issuing the NOA))

I wouldn't wait - I would do, and get it done ASAP, but that is me :)

on her vaccination documentaion sheet (provided by US department of state), the results say "vaccine history incomplete" and that "applicant may be eligible for blanket waivers because vaccinations not medically appropiate"

the vaccinations she couldn't get, it is checked "not age appropriate," "insufficient time interval" (i think this is the tetanus one, since it's a 6 month interval) and "not routinely available."

when i send the AOS packet, i will just send this sheet with an explanation letter. do you guys think that might work? i feel like that's the only possible solution..... do you guys agree?
