KIEV INTERVIEW TIMING CONFLICT

Timeline

Here is the situation:

On July 27th, 2009, I received the appointment letter from the National Visa Center (NVC) notifying me that my wife’s interview has been scheduled for September 9th, 2009. Unfortunately, my wife is subject to the two year home residency agreement, or Rule 212(e). At the time of the interview, she will have fourteen and one half months left to fulfill this requirement. As a result of this letter from the NVC, I am left with the following questions:

Should she keep this interview appointment?

Can and should this interview be rescheduled to a later date, closer to when a visa can be issued?

What other advice can you provide that can help me clarify this situation and process?

I simply do not want to waste time and money by appearing at an unnecessary interview. At the same time, I am afraid that everything that I have done to this point will expire. I hope someone can enlighten me here.

I think she should go to the interview, because you might be able to get a waiver for the requirement. If she does not go, I doubt she'd be able to delay things for another 10 months until the home-stay requirement is up, so you'll loose the money anyway.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hello, My wife is also subject to the 2 year requirement and we just got our NOA1. Good news for me is I am nervous about it being denied before our waiver is approved (should take about 2 months)

One of the reasons the Philippines government issues a No Objection Letter for a 2 year waiver is if you are married to a citizen.

It is really different depending on where you are from so I would check your embassy. However, getting said waiver is impossible in the time that you have. I would consult a lawyer as I am not sure if they would deny your visa or just hold it for you until the 2year is up or waived.
