Hi everyone!

Just a quick update on our I-94 drama. We didnt give up on trying to get my husbands I-94 Arrival/Departure Record as suggested by Customs & Border Patrol. In fact their exact words were, "Theres nothing we can do, the burden of proof is on you to prove we didnt give your husband the I-94 upon arrival to JFK." I understand their position & maybe they hear these stories all the time, however, they verified with me that he isnt even in any system they have which just validates our story even more.

Well we had an info pass appointment this past Tuesday at our local field office, the gentlemen was very nice/helpful. He asked why wewaited so long & we told him of all the calls we made,misinfomration we receieved & the fact that I was dealing with my dreadful insurance company as we hit a deer (buck) on they way home from JFK the same day I picked him up!!!

He made a phone call to another CBP office. I dont know what was being asked but I specifically heard him state the customs agents name who processed my husband and that there were absolutely no tape and/or staple marks in/on the passport. They requested we fax all supporting documents/evidence to them with a letter explaining our situation and why we want the fee waived.

So were really hoping luck turns around for us & they approve our request! Thanks for everyones advice!

May 11, 2010 - text message stating application received

May 13, 2010 - NOA1 for AOS

May 17, 2010 - Biometrics letter rec'd

June 10, 2010 - Biometrics appt

August 03, 2010 - AOS @10:45 am - "conditional" approval pending corrected medical form by Civil Surgeon

Sept 8, 2010 - AOS Approved for 10 year Greencard!!!

Stacy that is nuts that you had to go through all of that, but I am so glad that you did. It shows sometimes that you really have to just pull it together and stick to your guns with them. Sometimes they want to act like they know more than you and your situation when they don't
