2007 - Married (I'm on F1 status, husband is LPR)

Aug. 2007 - Met Lawyer

Nov. 2007 - Lawyer filed I-130,I-485,I-765 (yes, he filed it altogether :o )

Dec. 2007 - Received Rejection Notice (all check amount was incorrect, :oops: , 1st Lawyer's fault)

Jan. 2008 - Lawyer filed it altogether again (we didn't knew he was doing it wrong)

Feb. 2008 - Received Rejection Notice AGAIN (check amount was incorrect for I-130, priority date is not current for I-485&I-765 :protest: , 2nd Lawyer's fault)

Mar. 2008 - Lawyer filed it altogether for the 3rd time

Mar. 2008 - Received Receipt Notice for I-130, nothing for I-485 and I-765

June 2009- Husband became Naturalized US Citizen

June 2009 - Updated I-130 (Representative updated address not the I-130 :ranting:)

July 2009 - Updated I-130 AGAIN (They told us last month that they could do service request after 30days of 1st service request)

July 2009 - Received letter from VSC stating about our call to update the I-130

July 2009 - Called USCIS again and asked about the I-485 and I-765 (Representative said that the only file that they had was the I-130)

Please help us..

What should we do??? Do I need to tell my stu**d Lawyer to refile the I-485 and I-765, eventhough the I-130 is still pending???

It's been 2 years since our lawyer sent the I-485 and I-765. Do you think it got lost in VSC or what???

We really really need your help and suggestions :innocent:

I am not positive, but you will most likely have to file the I-485 and I-765 again. This is due to the fact that when your lawyer intitially filed everything together your priority date was not current. Thus, you were ineligible to adjust status at that time because there was no visa available. [Hence the reason why USCIS has no record on file/why you did not receive a NOA1] Now that you have updated your status and are immediately eligible to adjust status, you can file the I-481/765.

My husband and I initially filed the I-130 and did not file the I-485/765 until five months later. They waited to approve our I-130 until our interview for the I-485, but after the interview we received notifications that both were approved. It should not be a problem if you file the I-485 now, but you may want to consider consulting another attorney. At any rate, I hope it works out for you!

If you are married to an LPR you cannot adjust from within the US. You can only file all forms had you married a citizen. You have no visa available by being married to an LPR. Seeing your time line you SO is now a citizen now you can file the I-485, I-765. The reason all of these were returned to you was because you could not adjust being narried to an LPR. Now that they are citizen re file with the fee of 1010.00. Do you have a receipt number for the I-130??

Why is it that the only one who can stop the crying is the one who started it in the first place?

Dump the lawyer and do it yourself. Sure isn't magic to do so unless your case has out of the ordinary circumstances.

That definitely makes more sense....which concerns me that your lawyer was not aware of this/was not paying attention

As someone who knows how expensive attorneys can be, if your case is straightforward I would definitely do the work myself.

Thank you guys for helping. We do not know about immigration proceedings before, and as time goes by, we were researching, we almost knew how to do it. Like when my husband file for his citizenship, we are the ones who did it and now he's a citizen.

The thing is, we already paid our lawyer for the petition and applications. He is the one who wrote a check for the applications that he filed.

I'm going to call him today and see what will happen...

my lawyer mess my case too

i saw the vj and thank god for it

now i did my case just following the guide in vj

easy and take time to fill the forms and thats it

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg

If you signed a G-28 it's best if you have your lawyer withdraw it.
