Pls help-I130/DCF from India

Timeline

Hi Friends,

I got a married to a Green card Holder in 2008,May.Marriage took place in India and she went back to complete her studies. She filed for N400 on July 2009 hoping to become citizen in September/October 2009. Pls help me with the following querries:

1. Shall we file for I130-DCF from India or from US.?

We heard that filing from US will now take only 6-8 months. So if she files for me from US in October 2009(once she become a citizen) , hopefully by April/May 2010 we will be together.On the other hand, she is planning to come down India on December 2009 and to stay with me for 3 months(if the current rule of 90 days is valid in India) and then go for DCF from NewDelhi in March 2010.In this way hopefully by May/June 2010 we will be together.But we are totally confused where to file ....

We understand the pain of thousands who are in the same situation and we refer this forum daily.Pls help us to get me a clear picture ....

09-24-2009: Check cashed.

09-28-2009: I-130 NOA1 hard copy received

08-03-2010 Login Failed !!! AVR updated-"Your case was completed on March 8th"

11-03-2010 Interview scheduled on 13-Apr-2010@Chennai,India-email received from NVC-

43 days@NVC and 156 days from I130 filed for case complete...!!!!!!

16-03-2010 Packet reached Chennai Embassy (used DHL tracking method)

22-03-2010 Chennai website updated with my case# in the April IV appointments!!

30-03-2010 Medical exam scheduled@Appolo,Chennai

Hi

Currently she is an Indian Citizen having land/home in India in her father's name. She will be coming to India may be as a visitor once she becomes a US citizen....

If she really will be able to become a citizen and file the I-130 in October, you might still be able to be together by May or June. Because you'd be filing for DCF five months later and the current processing time at USCIS is 5 months it won't really save you any time.

I'm also not sure how DCF works for a dual citizen. Once she takes her naturalization oath the U.S. will consider her a U.S. citizen. I'd imagine they'd want proof of her residency in India, which usually takes the form of a visa in her American passport. India of course will not issue her a visa if she is a citizen.

I could be making something out of nothing there. Maybe someone else who has filed for DCF as a dual citizen will have a better idea of the repercussions there.

She can apply now for the CR-1 and send the I-130 to USCIS. This way you'll have plenty of time as when she becomes a USC they'll update your case anyway :thumbs: Don't need to waste time ;)
