The more I read the more confussed I am. We have been married for 2 years now. We have not filed any paperwork yet. I know I am to file the I-130. is that the same as the IR-1? And do I still need to file an I-129?

I think I am reading that since I have been married 2yrs that I shouldn't have to file an ajustment of staus after gaining entry because it should be apart of my initial forms is that a part of the IR-1? and What is a CR-1? Are these actual forms or are they just a process?

I-130 is a petition

CR-1 is a visa for aliens married less than 2 years and will require removal of condition (NOT adjustment of status)

IR-1 is a visa for aliens married more than two years and results in a 10 yr green card

It takes an approved I-130 petition to qualify and alien spouse to apply for an immigrant visa (either IR or CR)..

I-129F is a petition

K-3 is a visa

It takes an approved I-129F petition to qualify and alien spouse to apply for a K-3 visa.. and will require Adjustment of Status after US entry

YMMV

I-130 is a petition for an immediate relative.

Whether it be father, mother, sister, brother, husband, child, etc.

If you file I-130 for a spouse...you fall under a IR-1 category if you have been married for over 2 years.

If less than 2 years than its a CR-1, which means Conditional resdient.

I-129F is either a K1 visa or a K3.

K1 is if you are not married to it pertains to a fiance visa. and you pay the charges to file it.

K3 if you are married. then its called a spousal visa. you dont pay anything cause you file it after the I-130 which you pay for.

K3 was a hot thing when I-130 was taking really long to approve. So K3 was quicker and expedited the process a bit.

However, now I-130 and K3 both take the same time, so no reason to do it.
