Ok it looks like my cousin got himself in quite some trouble...

He went to the US at age 8 in 1991 with his mother.Got his 10 year Green Card in 1994,was married to a US Citizen for a while and got divorced. He has two young daughters (of course US Citizens ) in the USA.

Come to find out now ,after his 10 year Green Card expired in January 2004 he didn't do anything to renew it or become a Citizen!

What is the legal situation now? Can he be deported? Is he out of Status? Does he have to do anything in order to get that situation straight? His father is NOT a US Citizen and his stepfather who is never id adopt him.

Please,if someone can give us helpful information do so as my cousin wants to get married on August 17th and that issue is hanging over the couple now.Unfortunatley my cousin thought that he automatically becomes a US Citizen after 10 years.....

Nat

Met on May 17,2005

Got engaged on Sep 15th,2006

Came to the US for good on Jan 27th,2009

and we got married on March 28th,2009

GOD , grant me the serenity

to accept the things I can not change

the courage to change the things I can

and the wisdom to know the difference!

Q. What should I do if my Green Card has already expired? Will the INS penalize me for renewing my card after it expired?

A. If your Green Card has already expired, you should apply to renew your card as soon as possible. Those renewing expired cards will not be penalized.

He's still in the US right... then he hasn't done anything 'wrong'. His biggest problem would be if he left the country and lived some place else AND let his green card expire (because that could be seen as surrendering his status)

Citizenship is not automatic - if he wants to marry somebody who is not a US citizen he'll have to apply and wait to take the oath before he can do the paperwork for her... but you don't say what her status is - that's really the only problem I could imagine it causing that was 'urgent'.

Karen - Melbourne, Australia/John - Florida, USA

- Proposal (20 August 2000) to marriage (19 December 2004) - 4 years, 3 months, 25 days (1,578 days)

STAGE 1 - Applying for K1 (15 September 2003) to K1 Approval (13 July 2004) - 9 months, 29 days (303 days)

STAGE 2A - Arriving in US (4 Nov 2004) to AOS Application (16 April 2005) - 5 months, 13 days (164 days)

STAGE 2B - Applying for AOS to GC Approval - 9 months, 4 days (279 days)

STAGE 3 - Lifting Conditions. Filing (19 Dec 2007) to Approval (December 11 2008)

STAGE 4 - CITIZENSHIP (filing under 5-year rule - residency start date on green card Jan 11th, 2006)

*N400 filed December 15, 2011

*Interview March 12, 2012

*Oath Ceremony March 23, 2012.

ALL DONE!!!!!!!!

By way of FYI, shouild anyone fall into this unusual situation....

The card expires, the status does NOT. This is true for in or out of the US. There are other factors that would probably contribute to losing PR status if out of the country a long time, but card expiration & out of the country is dealt with in the following links:
