Re-Opening a canceled File

OK so I am in need of BIG HELP. I am in America and my fiance is in India. And so I was going through a hard time which led me to call off my wedding, and I canceled my fiance's file. And now my fiance and I have reconciled and now I want to get his file re-opened so he can get his interview asap, and he can get here soon so we can finally get married! How do I go about getting his file re-open?!? Is there an easier way, I just hope and pray I dont have to go through the entire process and pay all those fees again! That would be ridiculous I would cry. Please someone help me! Thank You all!!!!!!!!!

As far as I understand, since you willingly withdrew your petition, that closes out your case.

In order for you to petition your fiance again, you will have to refile the case, and pay the fees again.

Since your petition does not simply 'wait', you must understand that they close out the case and move on to the next one.

SOrry to say...but it will be a dent in your wallet

i too believe you just have to start over, once closed i would think it stayed closed until a new case is filed and opened having no ref to first case (other than maybe explaining why the closure)

How did you cancel it? Did you write a letter and get confirmation of the cancellation? If so, I'm afraid you're going to have to start all over again. If this was something recent, maybe you can follow this up immediately and get it "un" cancelled! I'm sorry if you're going to have to start this all over again! :(

Well i sent a letter to the embassy in Mumbai saying to cancel it, i never received any info after that. I never sent a letter to the USCIS or NVC saying to cancel it, but apparently i asked the Mumbai embassy they send the file to NVC to get it revoked upon my request so now I will be calling NVC tomorrow and see if I can stop it from being revoked and hopefully not start over because that is so much work! I just want my fiance here asap :(.

I kinda did the same after a fight with my fiance. I sent an email asking them how I could cancel my petition and then immediately regretted it. I sent them another email telling them to ignore my previous email and they did as far as I know because I never heard from them on it, though they were 'probably' suspicious about the sincerety of our relationship because of it.

Anyway, afterwords he still went to the interview and was placed on AP until he could submit the extra requested documentation, such as his voters card, a copy of the past 5 years voters list from his local Elections Office, a notarized copy of my Passport including entry/exit stamps and a statement from him telling how we met, when we fell in love and why we decided to get married.

After he did this, the CO was still not convinced, I don't know if my above email had anything to do with it or not.

Eventually though, after the USCIS received my returned peition and reviewed the CO's notes, the USCIS re-affirmed my petition and sent it back to the Embassy without asking me for more proof (an NOIR or an NOID). I hope this give you some hope on your case.

At the very least, it can serve as a cautionary tale to other couples: when it comes to the visa process, don't make decisions in the heat of the moment. You're liable to regret it later. Even if you think it's really over, just let the petition die—if you change your mind later, there may still be time to restart the process. But if you pull the trigger like the OP did, there's no going back—except to square one.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.
