Hello everyone!

My husband Hassen arrived this past Friday June 26, 2009 POE was JFK. He didnt receive the I-94 form from Homeland Security/Border Patrol/Customs.

Were wondering what our options are now? USCIS has a fee of $320 to pay but do we have to since we never received it upon arrival? Has this happened to anyone here before? Please share thoughts/experiences we really want to keep this ball rolling with paperwork...thanks in advance...Stacy & Hassen

May 19, 2009 Interview Day @ 11:00 am - PASSED!!!!!!!!!!!!!!

May 20, 2009 Picked up VISA

June 26, 2009 Prince flies to America, arrives to JFK - exactly 18 months from the day we met!!

The Journey through AOS:

May 05, 2010 - mailed I-485

May 11, 2010 - text message stating application received

May 13, 2010 - NOA1 for AOS

May 17, 2010 - Biometrics letter rec'd

June 10, 2010 - Biometrics appt

August 03, 2010 - AOS @10:45 am - "conditional" approval pending corrected medical form by Civil Surgeon

Sept 8, 2010 - AOS Approved for 10 year Greencard!!!

I would try calling where he came through tomorrow and see if they are willing to reprocess him. It is their mistake.

Oh Wow Stacy I would try calling them because you might be able to save money from that fee....how is it with him being home? Great I bet.....

First off, Im happy for you guys and glad is home safe.

I have never heard of it before. I dont have any advise, sorry. I hope you dont have to pay the fee. It does say this:

Note on Filing Fees for I-102:

You do not need to pay a fee to request to correct your Form I-94, I-95 or I-20ID if the error(s) on your document was made by USCIS, through no fault of your own.

Please consult the "Paying Fees" section of your local office or Service Center page to learn which forms of payment are accepted. Acceptable forms of payment may vary by office. Checks must be made payable to Department of Homeland Security or U.S. Citizenship & Immigration Services.

Hopefully they can easily see that he wasnt issued one to begin with and that is "no fault of his own"

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.
