CR1 Approved - Entering US for the first time...

Timeline

Hey!

My CR1 visa has been approved. Do I have to go through immigration the next time I travel to the US? I plan on 'officially' moving sometime in September, but have a 1 week holiday to California in July. Will I have to do the immigrant processing when going on my vacation? Or can I wait and do it when I'm moving in for good?

I-130 NOA1 : 2008-08-15

I-130 Approved : 2008-12-18

Received DS-3032 /I-864 Bill: 2009-01-08

Pay I-864 Bill: 2009-01-08

Receive I-864 Package : 2009-01-23

Return Completed I-864 : {b] 2009-02-21[/b]

Return Completed DS-3032: 2009-03-18

Receive IV Bill : NVC mailed it on 2009-01-26 but we paid without having received it in the mail.

Pay IV Bill : 2009-02-04

Receive Instruction Package :

Case Completed at NVC : [2009-04-09]

Interview Date : [2009-06-19] *APPROVED*

Visa Received : [2009-06-25]

US Entry : Not sure yet, but going on vacation there in july!

Jan. 28, 2010 - VISA received

Mar. 03,2010 - POE, New York (JFK)

Apr. 12,2010- CA ID

May 20,2010- CA Driving License

May, 25,2010-Wife told me that she is pregnant ^_^

Jan.25,2011- Our daughter was born

Can anyone answer my question regarding the border crossing?

I've can't find anything to back it up but I think I remember reading somewhere that you WILL have to use the visa when you enter.

Do you have any particular reason for not wanting to use it? If anything I would think it'd be a good thing. By time you officially move in September you'll already have a social security number so it'll be easier to get a job/apartment/ bank accounts etc. and you'll already be three months closer to removing conditions.

In theory, you could continue to use the VWP when you enter, but the immigration officer may wonder why there's a new Visa in your passport that you're not using. For expedition, I'd just come prepared with the package to be processed.

On a related note....I'm pissed off (not much, but a little) that currently, entering LPRs have to be finger printed and photographed as if they didn't have a green card. This is new within the last 90 days.

LingLing - just technical but Canadians don't enter on a VWP.

canadianwife - nice name by the way - it will be up to the CO on whether you activate the visa or not, they will likely ask you why you don't want to activate it but like LingLing said, go prepared with the packet to have it processed.

I was fingerprinted but not photographed when I entered last week. Didn't piss me off at all

come on now not to be mean but why do u want to waste time on your green card production. enter the US and start the process right away u can always go back on your temporary CR1 visa which i thing for everyone is good for 6 months.

Congrats and sorry I don't really know an answer. Although my guess is as follows: Is Canada on the waiver program? If so, then perhaps you could come on that? If not, then I would imagine you have to do the immigrant processing on your trip in July.
