Is it possible to get I-551 stamp w/out I-751 receipt?

Hey all,

So I managed to get into a pretty difficult situation. :wacko:

My wife's green card expires in late August. I have the I-751 package pretty much finished (I can mail it out tomorrow). All of that is fine, but here is the problem:

We have a trip scheduled to Spain (in two weeks! :blink: ) and the only road block is that for my wife to get a visa she needs a valid green card for 3 months (it's only valid for 1.5 months ). I don't have time to wait for a NOA from I-751.

Is it possible to make an infopass appointment and get a stamp that extends the green card by 2 months?

Any help is appreciated.

P.S. I can get an infopass scheduled for tomorrow (Fri, June 26th) and that should give us enough time to get the visa.

It's always possible to get an Infopass.

But - it's up to them if they wish to stamp that.

By all means, go get it.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Ok, I have made an Infopass appointment for tomorrow. I guess my main concern now is: What are the chances that they will actually give the stamp to extend the green card for 2 months? I am not too optimistic. :(

I try not to figure in "chances". Either they will or they will not. Only thing left is to try :thumbs:

Worst case, they don't - you change your trip plans.

Best case, your on your way!

Hi,

"Bobby_Umit" has answered your question pretty much. But i will try to address it as well. Yes infopass is possible and normally USCIS wants you to make infopass only if you it's been 45 days since you heard from USCIS via email or mail.

1-

The I-551 stamp is given in different situations. If it's been 30-60 days since you filed I-751 and didn't get NOA (Notice of Action, or application application which also serves as temp GC for 1 year i.e. extension of work and stay upto 1 year added to the date 2 Yr GC expires) so if you didn't get NOA you can get I-551 stamp on your passport.

2- If you case takes more than 1 year and preivious I-551 stamp or NOA expires then you can also get I-551 stamp via infopass appointment.

3- If you got approved for I-751 and didn't get your GC 30 days after your approval notice you can also get I-551 stamp on your passport ( according to new USCIS rule, this might be temporary check USCIS website).

So in your case, I am sure they will tell you to wait for the NOA and if you don't get NOA then come back and ask for I-551 stamp on your passport. So it all depends on your Immigraiton Officer (IO) at infopass appointment.

I have no idea whether they actually will or will not stamp the passport, just my opinion is that due to nothing being filed yet they may not do anything.

I had my passport stamped for a year last week as my NOA1 had not arrived yet (had been almost 30 days) and my green card was about to expire so they gave me the stamp but before giving the stamp they took my passport and green card and searched for my case and made sure I had one before they just went ahead and stamped me.

K-1 visa issued: 12/15/2006

107 days from mailing AOS package to receiving green card! Received 6/27/07 dated 6/20/07

Removing conditions:

mailed 5/22/2009

Recieved at CSC 5/23/2009

Check cashed 5/27/09

NOA date 5/26/09 - still not received

I-551 stamp in passport 6/19/09

Biometrics notice date 6/16/09

They cannot stamp your passport to extend your green card if they don't have proof that you have already filed the I-751. That means it needs to have been received and entered into the system - they can check using your A number. You can file asap and hope that you get the NOA1 before you leave; you can make another infopass for after the I-751 has been filed closer to the time you leave and bring proof of your travel plans and hope they will give you the I-551 stamp, or you can make sure that your wife returns to the US before her green card actually expires

That is what I was thinking. I don't see them stamping anything, since you have not submitted your I-751.

hello,i have a Q for u pls,i have submitted my i-751 the same exact date u did and to the same center as well the CSC,my check was cashed at the same date as well on the 15th of july,the thing is till now i haven't received any thing in the mail yet,no receipt no letter no nothing,so my Q for u is when did u receive yr first letter from them?i am a little worried and i tried looking up a phone # for CSC and i couldnt get nothing,i dunno what else to do.

Have you gone to the July filer thread and checked all the dates of people who have filed around the same time as you? Did you check the copy you made of the I-751 to make sure you put the correct address?

Why is it that the only one who can stop the crying is the one who started it in the first place?

Kaban, at this point you need to mail the I-751 via express service.

What country is your wife from? Are you sure she needs a visa? You can visit this site, click on "visa search tool" in the left column.

Apologies for not updating the topic at the time, but I DID get the stamp! It was a bit awkward from what I remember. We came to the appointment with the I-751 package ready to mail. It took some time to explain and the guy was asking why we didn't mail it sooner, etc. He was hesitant about given the stamp, but I just stood there and refused to leave* and finally he decided to go ahead and stamp it.

Don't remember if it was directly related to the stamp, but I remember that flying back to US from Spain caused some confusion on the Spain side during check-in. They had to run back and forth to the supervisor and it added a good 45 minutes to the check-in time.

*Edit: Not that he asked us to leave, just that I kept asking him questions, clarifying the situation, etc.
