Need to hire a lawyer with HCM office

OP,

What were you thinking when you filed for your case without consulting an experienced immigration attorney like this one, luatsutuan.com?

Here's my 2©:

1) On a personal note, have you thought thoroughly when you decided to move forward with this relationship? I think the CO is doing you a personal favor here! It is not too late to reconsider. Love is blind and you obviously are NOT seeing "her pattern" (3 times already, you want to be the statistic being the fourth?)

2) After all that being considered and you still want to move forward anyway, retain an attorney NOW! no but, why, what, when. You should have done that way before filing the paperwork. Why? for your protection! In the event you change your mind or whatever later, you "can" refile paperwork for another one without jeopardizing that case inadvertently. Trust me, she's been there, done that THREE times and this game is not new to her. She can and willing to repeat the cycle more often than you can imagine!

Just remember, life over there in VN is NOT real! Your money will be worth a LOT less once you get back over here. Back to reality, cowboy!

This can usually be done without an attorney, but I agree that given the circumstances an attorney would have been advisable.

I also tend to agree that the OP should be seriously examining his fiancee's intentions. She divorced the first petitioner and married someone else before adjusting status. Was the second husband an LPR? Was he a Viet Kieu? If so, it's highly probable she married the first K1 petitioner just to get to the US and be with the second husband. Is it possible she divorced the second husband in 2007 because he never managed to get her immigration situation worked out, so now she's looking for another K1 in order to get back to the US, eventually divorce the petitioner, and reunite with the second husband?

I don't know if any the above applies, but this is certainly what the consulate is thinking...

I did consider about her situation so I did take it as slow as possible before committing into it.

Answering to some of your questions, the second was not a LPR. He very much grew up in states. After she was back in VN, basically he was AWOL.

It seems like lawyer is a must. I just don't know if getting now or after the 2nd appointment.

Good lawyer is hard to find. That is why I am looking for references. If you happen to know one. give me some pointer.

My question is do you love her? or do you think she really in love with you? If both answer are YES. Move forward with all the paperwork, hiring a lawyer, and ets, and do all your best to bring her over here to start a new life with you. If one of the answer is NO, moved on and don't waste your time for her.

When you say "grew up in the states", I'm presuming you mean he's a US citizen by birth.

Ok, I'm just going to throw out a few more random questions. Bear in mind I'm thinking like a consular officer here...

She was married to two different US citizens. Did she ever attempt to adjust status? If not, why not? If the consulate digs into this (and they will - that's why they want information on the former spouses) are they going to find out she came to the US and married the petitioner because she thought that's all she had to do to satisfy the visa requirements, and then divorced him to marry the second husband?

Did she say she returned to Vietnam on her own, while still married to the second husband? If the consulate digs into this (again, they will) are they going to discover she returned because she found out she was out of status, and returned to avoid being deported and banned? Further, are they going to discover that she got divorced from the second husband because she realized she would never obtain legal status through him, and needed to seek a different route to return to the US and obtain status?

We've already given you the name of one of the best attorney's you're likely to find for immigration from Vietnam - Marc Ellis. He spends most of him time living in Ho Chi Minh City. I doubt any immigration attorney in the world knows the HCM consulate as well as he does. Don't wait. This may be your last chance to make your case. The timeline could be key that will make the differences between getting a visa or having your application sent back to USCIS. You really need expert assistance.

I am glad to give an update about our case. My fiance just called and informed that she got PINK after summiting all requested docs. I just want to say thanks to all of you, especially anhmap, JimVaPhuong, JackandXuan, ToddandHien,daitx for taking time to answer my questions.

I took a big gamble when I decided against hiring a lawyer for my tough case. Instead, I spent a big effort preparing a four-page timeline. I think it is a big help.

For ones reading my hard case, no matter how hard the case is, you will get PINK if you do enough research in this forum.
