Timeline

Need some advice Will keep it Simple

Basicly Fallen for an American

She's going/getting a divorce and will be deported

I love her and want to be with her

So a K-1 looks like the best option and i need to know what the criteria are

She has nothing there so when she goes back she will have no place of her own and no job

I have some money and a degree (willing to take any job if i have to)

What are the options availible for me

Could i get a K-1?

Also someone has mentioned that obtaining a co-sponsor?

Is this viable and if so whom could be the co-sponsor?

Advice would be helpful...

Did she come here originally on a K1?

Why will she be deported?

When she goes home you can file a K1 for her and wait. Or you can go to her country and marry her and file a CR1 or K3 (probably not THE best option). Read the guides to decide which visa to use.

If you don't make enough money to be at 125% of the poverty line for your household size (including her) then you will need a co-sponsor. Anyone can be a co-sponsor if they are willing to take on the responsibility.

Is she the US citizen? Deported from where USA or UK?? You need to give better details when posting.

US citizen files the I-129F for the K-1 visa, this is done only after divorce is final.

As for support, this is not an issue when filing the I-129F, it is an issue at the time of visa interview.

US Embassy UK does consider foreign citizen's assets for support, and also income ONLY if the income will continue after UK citizen moves to the USA.

Ok - that helps out with your falling. I take it, deported from the UK?

Yep - you mentioned that above.

That is not good, she will need 125% poverty level to sponsor you to come on a marriage visa

Well - you should be working anyway, but that will not help her sponsor you.

Yes - as long as she solves the job/sponsor issue.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Please be more specific. Americans do not get deported, I am completely confused.
