Just realized that we didn't file an AR-11 when we moved! :o (We've moved twice since coming to America; same state, different cities within 25 miles of one another.)

We'll be filing our I-751 at the end of the month. Our last move occured end of May 2006, so we're going to immediately file an AR-11, but do you think we'll be penalized in any way for not filing one when we moved in October 2005?

OMG! I am in the same situation. Just realized this last night while browsing for info regarding removal of conditions...

I received my conditional PR Card Nov 16 2004, and moved in July 2005, 5 miles from the old address, but different city...

6-18-04: A 3 1/2 day trip finished, Steve settled down in Sacramento, CA.

6-29-04: Successful Interview @ KL Embassy!

7-22-04: Arrived home in Sacramento, thru SFO.

~7-25: Steve's Happy B-Day

8-04-04: Appied for SSN --> Card received 8/13/04

8-10-04: Married at Sacramento County Clerk-Recorder

8-18-04: AOS and EAD filed @ USCIS Sacramento Suboffice

9-18-04: NOA1 received

9-21-04: Name corrected (to right order) in SAVE thru a phone call and an email

10-12-04: Appointment for EAD. Got the card.

10-27-04: Fingerprinting done.

11-16-04: AOS Interview. A breeze... We got approved!

12-06-04: Permanent Resident Card came in mail.

9-02-07: I-400 filed

4-21-08: Interview in Sacramento. Approved/passed. Case then forwarded to Los Angeles (as we live here now)

7-11-08: Naturalization Ceremony. Certificate received. Glad to be a citizen.

7-16-08: Filed I-130 for Mother.

8-14-08: I-130 approved. Kept calling NVC automatic # for case update - no record found.

9-08-08: Mail received from NVC with AOS (I-864) bill & DS-3032. Paid fee online, mailed DS-3032 form w/ barcode.

NVC automatic phone service still says no record for either INS # or NVC #. But as long as things are moving...

I wonder if we should quietly file the AR-11 for me and I-865 for my husband (the sponsor) now, or shall we attach a letter saying we are sorry we didnt know...? Should I go to the local USCIS suboffice and ask them? or will it only make it worse?

I would file the AR-11 at this time...

I would suspect prosecuting someone for failure to file an AR-11 would not be a judicious use of either ICE or US Attorney resources...

The important thing is the form (at least it is supposed to) updates your adress in the immigration office computer, so they know where to send any further letters to you. Although this does not always work, I missed an appointment when they send the letter with time and location to an old adress, but since I had filed form AR-11 they did not argue about me missing it, they just gave me a new appointment date since they were responsible for the mistake in the first place.

Again, the AR-11 does NOT change your mailing address.

Changing your mailing address via a new form (your I-751) does NOT comply with the rule about reporting your address.

They go to/happen in two, unrelated places.

You are required to file AR-11, and your Sponsor is required to file I-865. Relevant laws are cited in the links below.

To successfully change address, from the Dept of Overkill:

-file AR-11 as required by law. This does not change your *mailing* address, but it informs USCIS where you might have been, at one time. Just do it, it's the law http://uscis.gov/graphics/howdoi/address.htm

How Do I Report a Change of Address to the USCIS?

AR-11 does not generally generate a NOA receipt. Send by trackable mail.

-Copy of AR-11 to any LOCAL or district office where you might have a file. Include a letter saying: change my mailing address

-copy of AR-11 to any Service Center where you might have a file. Include a letter saying: change my mailing address

-Phone call to 1-800 MisInformation line with the request: please change my mailing address

-file I-865 for USC Sponsor as required by law. You *may* get a NOA for this one and it *might* change the Sponsor's mailing address. Or not.

-file Change of Address and Mail Forwarding with the USPS. Your USCIS mail *might* get forwarded to your new addy. Or returned to USCIS, you never know. Unfortunate side effect: the PO sells your new address to bulk mailers and you are now back on every junk mailing list under the sun.

-Follow up phone call to 1-800 to see if address change is captured.

-Cross fingers and keep an eye on processing times and when you expect to be contacted. Don't let it go for ages and then say 'dude, where's my case?'.©

Thank you, zyggy and everyone. I sent the AR-11 and I-865 out today too (to 2 different addresses). It's exactly one year late, :rolleyes: but I hope it won't be a big problem...

You're right ... my daughter was a joint sponsor, so it's back to the drawing board and the filing of an I-865 for myself.
