Passport question

I have a 10year passport that expires in 2010, but it says on the 129f file form that your passport must have a 5 year validity? So does this mean I should apply for a new passport? I just assumed you had to wait till your current passport expired before obtaining another. Also will they take my old passport because, that has the stamps from my 2 trips to the Phillipines and I kinda like those for my evidence.

Are you the US citizen petitioner? If so, you only have to submit a photocopy of your passport with the I-129F, and ONLY if you're using it as proof of your citizenship. If you have a copy of your birth certificate to submit, then you don't need to submit a copy of your passport, though copies of the pages with the visas and stamps are good primary proof of having met your fiancee.

I haven't had to renew my passport yet so I have no idea if they take the old one.

It says "issued with a validity greater than 5 years" that means you must have a VALID "adult" (10 year passport) You do. That is also IF the passport will be used for proof of citizenship. A birth certificate works just as well.

Read all the instruction carefully, and interpret them exactly literally. If it says "copy front and back" then copy front and back. You will copy a blank page. Write on this blank page "copy of back of birth certificate", if you do not you will delay your case for weeks with an RFE for a blank piece of paper.

Durint this process, whenever faced with the thought "Do they really mean I need to do this?" The answer is YES.
