taxes marred but filing seprate

Ok i just just through putting my package together and i waz told dat because we did not file married jointly we can be turned down does anyone knows if this is a MUST we have 2 do it or it is grounds on us being turned down :crying:

I don't know for certain, but that sounds made-up. You file based on your preference, whatever works best in your financial situation. The USCIS might ask you why you did it that way, but no way should you be denied because of that. Just my opinion, though.

We filed this year married seperate too only because it increased our refund. We filed for removal of conditions as well last month and so far we have not even received a NOA1. I don't see why it should matter as long as you are still married, living together and happy, but of course we're talking about USCIS so who knows....

They won't deny because of filing separately. It's perfectly legal to file separately. In some cases, it will reduce the amount you pay. In most typical cases, it will increase the amount you pay, and it some cases, it may not matter.

If your tax situation is such that you ended up paying a lot MORE filing separately than you would have paid if you'd filed a joint return, they may wonder why you made that decision. Unfortunately, a common reason why couples file separately is because they're about to divorce, and they won't speak to each other enough to get together and sign each other's joint return. You'll want to make sure they don't incorrectly assume your separate filing was because your marriage isn't good.

They might ask you why you filed separately. If you've got a good reason for filing separately, you might choose to explain it in a note you include in the I-751 package, instead of waiting for them to ask you about it. But then again, they might never ask, even if you don't offer an explanation.

In the end, what matters is the overall big picture.

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

we filed separately ever since, just got approved.

Thank you guys sooooo much i am stressing and pulling my hair out while my husband as cool as ever, he said if they want another interview we will give to them ( I love this man ) but we are going to add our letter on why we did not file together..Again thank you and you all made me fell 100% better
