Can my daughter be in my I-751 form? "Verification of Inclusion of a Dependent in Filing of Form I-751" receipt notice can be proof of extention?

Hello, everyone, I am very thankful for knowing this site recently from friends. How lucky we have such a place and can help each other.

I came to America for 2 more years already, I am eligible to apply the 10 years greencard now. When I read the instructions for I-751, I have some questions and I need help from you, thank you in advance for any inputs.

my daughter was K2, getting the conditional greencard with me at the same time, she is nearly 23, is she still a child and can she be included in my application form? She is working and living in a different city, is she a dependent in this scenario and can she be included in my application form in this point?

If I file I-751 including my daughter in my form, we would only receive a "Verification of Inclusion of a Dependent in Filing of Form I-751" receipt notice, that means that we would not receive a separate I-751 receipt and my daughter will not be included in the I-751 receipt issued to me, (a member who contributes great to Candle helped me to get the information http://www.murthy.com/news/n_conchi.html) I am wondering if I can have an infopass to get my daughter's passport stamped I-551 with the "Verification of Inclusion of a Dependent in Filing of Form I-751" receipt notice, or my daughter can use the "Verification of Inclusion of a Dependent in Filing of Form I-751" receipt notice as proof of the one year extention to travel, update her driver license, and for her employment eligibility? any knowledage and experience are highly appreciated.

Your situation is a little out of my league to give you 'for sure' advice, but I would not think that your 23 yo daughter would be able to adjust her status along with your I-751.

You stated she is 23, lives and works in another city, and nothing about how she is in any way dependent on you. However I did find this link at the USCIS which might be of help to you:

I believe you will each file the I-751 separately, but again, not one hundred percent sure myself. Good luck! :thumbs: Hopefully someone in a similar situation can come along and confirm.

  • August 1, 2007 AOS Interview! APPROVED!! EAD APPROVED TOO...
  • August 6, 2007 EAD card and Welcome Letter received!
  • August 13, 2007 GREEN CARD received!!! 375 days since mailing the I-129F!

    Remove Conditions:

  • May 1, 2009 first day to file
  • May 9, 2009 mailed I-751 to USCIS CS

ready4ONE, thank you very much. The memo is for AOS, so I think that it doesn't apply to I-751 application. My daughter is not dependent financially, but she is dependent on me in the immigrating process, she was K2, Am I right?

Yes, I hope that someone who was in this situation can give me some inputs. Thank you again.

If your daughter came at the same time as you to the US or within 90 days, she can be on your I-751, You only pay for one form and 2 biometrics. This is what we did when we filed in January. Good luck.

John24689, thank you very much for your inputs. Yes, my gaughter got the 2 years greencard with me the same time. I read the instruction for filing I-751 of USCIS recently, the instruction states that we can file my dependent child in my application form together, my concern is that my daughter is over 22, is she still a child, my daughter is working and living in a differnt city, is she dependent, I am thinking when they mean child and dependend, they mean she is my child and she is dependent on me in this immigrating process, but I am not sure if I am right. How old is your stepdaughter?

I also see from your timeline that your daughter received "Notice of Action", not "Verification of Inclusion of a Dependent in Filing of Form I-751" According to what I read from http://www.murthy.com/news/n_conchi.html, it seems that the son or daughter will receive that verification notice, not the "Notice of Action" if they file with the parent in the samr form, so I am confused here. Can the verification notice have the same use for proof of extention, so my daughter can use it to travel, renew her drive license, etc.?

My step-daughter was 22 when we filed. She lives in another state. She was on my wife's I-751. She had her biometrics in the other city. It seems it is the same type of situation. I am not sure what she received. She got the one year extension letter like her mother. There should not be any problem with your daughter being included on your submittal. Age should not be a factor if you got arrived at the same time or within 90 days of each other. Ours is close to being approved, I hope. Good luck.
