have some issues with filing for K1

Hi

I have been in a long distance relationship with a girl in Guangzhou China for about 2 years now. I have been there several times and one thing led to another and we decided to get married. I was actually thinking about moving there, but it is better that she comes to the USA. I have some problems with the K1 process.

Originally my fiance is from a very small village just north of the town of Tongjiang, which is located north of Harbin in Heilongjiang province, its name is QingPing also, neighboring village is very small too, its name is Er Long Shan. These are small farming communities that you cant even find on maps or google earth both are great places to visit BTW and you can stay for people that dont mind getting a bit adventurous.

She is currently 30 years old and for the last 4 years has been living and working in Guangzhou, China, where I met her. She works more or less as a "Trade Consultant", independently. She speaks fairly good English and knows Canton Fairs as well as many of the local garment factories, so she basically connects customers and helps them get the products they are looking for. Her life however has had some turmoil in it.

When she was young, she went through an arranged marriage while still living in her village. Needless to say it didnt last long and she left. Her final official divorce took place at Er Long Shan village, at a police station there. Since these are very small and close communities where everyone knows everyone else, the officials there knew her by her nickname, childhood name and put it down on the divorce document. It is basically the same name but one syllable is different. All the rest of her records match on it including the name, birthdate etc. of her daughter from that marriage, whom we plan to bring here in couple yearsafter she finishes school and whos living with her father now.

So the 2 names are not an exact match, it is very difficult to straighten out this matter, since its in China and in such a place, I am looking at travel costs + a LOT of "gifts" for the people doing this, in order to get all this done. Alltogether upwards of 20k USD, in order for them to correct this paperwork. I simply can not afford it, not even close.

So far I have used the misspelled name as an alias, where it says to list all other names used and had her write and notirize a document stating basically what is above and that she is same person. I will be filing it with my G-325A as an attachement. But I fear it may not be enough and the visa will be denied because of this.

Does anyone else have any ideas on how to deal with this problem ?

2nd, She does not know her complete address from her residence before Guangzhou, it is extremely different, in Wuhan, Hubei, it doesnt follow any of the western world address formats as far as city, etc. and on top of that we dont have a street or building address. is this also a big problem ? What can I do about this. We do have city, district, area, just missing street and building #.

So these are my 2 problems. I would greatly appreciate any advice, especially from anyone that has experienced similar situations.

I had a similar problem with my fiancee. I don't know if it's a problem yet because I haven't got my NOA2, but I can tell you what was recommended to me by an attorney and what I did...

My fiancee's "friendly" name is on some of her documents, but her formal name is on the important official documents. I listed the "friendly" name as an alias on the G-325A.

I included an address attachment for the addresses. Most of the addresses do not have a street name or number. Most have a person's name, followed by a village/town/commune etc. name, followed by district, and then province. I provided the addresses in both Latin script (probably transliteration, in your case) as well as native script. For each name and address on the attachment, I specified which part of the form the name and address applied to. On the form, I wrote "see attachment". I included a brief note at the top of the attachment page describing why addresses in rural parts of Vietnam cannot be written as street name and number, but I'm sure the consulate in Ho Chi Minh City already knows this - I mentioned it mainly for the adjudicator at USCIS.

The addresses I listed will work for mail, but they don't actually carry mail to most of the homes in these small villages. The people have to collect their mail at the post office.

but after few days ago the service center(california/vermont) where u filled or sent the k1 package will turn back to u to correct it

so better to be completed and correct before they start your k1.

surely that they will give u a notice to correctly your g-325a

The address thing is not an issue. Write it as best you know. City and province most important

Regarding the name, my guess is the officials at the consulate know these things. I think Pushbrk may be along and give a more difinitive answer. You can also email the consulate and ask them. My guess is you are not the pioneer in this matter.

We had a similar situation in Ukraine where the government, having declared Ukrainian the official language, arbitrarily changes the names of people on official documents from Russian names and spellings to the equivilent Ukrainian name and spelling. We had this issue in our documents. The consulate advised they would accept any reasonable spelling of names. My wife does translations for Ukrainian and Russian documents, a standard question of the client is "OK which of these names do you want ME to use?" LOL It is not unusual there to have multiple documents all with different spellings or even multiple spellings of the same name in one document. My wife's divorce decree spelled her name THREE ways and NONE were correct! The Urkrainian government agencies can be real sticky about it (at least until you give them some small bribe to overlook it) but the US embassy knows this and allows for it.

It's hard to say for sure. I think if there is a problem with the discrepancy in name, USCIS will be where the buck stops on this, not the Consulate.

2) Prior address does not need to be exact down to building # just city/province.
