Hi guys, hope your all well.

so last year i had my k1 visa granted in november. i moved over in december only to find my fiance was cheating on me. so in january i came home. we never married, i came home to scotland before my 3 months ran out. i returned my I-94 when i left the country. my question is...6 months on, am i allowed back in the states for a two week holiday? it would be to a differant state. (i moved to new york but want to visit maryland).

thanks for your time, in return im more than happy to answer any of your questions on my experiance with the k1 process.

You have VWP, so coming to the US on a visit should be completely acceptable provided that you've not violated any precepts of the visa waiver eligibility. Sounds like you have not since you returned before the expiration of your 90 days as stated on your I-94...so you should be OK for a visit.

Try this to reassure you:

http://www.usembassy.org.uk/cons_new/visa/visa_wizard.html

On the matter of visas, it doesn't ask if you have entered with a visa before, only if you've been denied one or if you have previously overstayed. If the answer to both is no, you should be fine (subject to the usual public health rules, etc). I suppose it's probable that the CBP officer will see your old visa in your passport (they're eagle eyed to say the least) and that you may be asked some questions about why you left and to make sure you're not going back to your past petitioner with the intent of staying. So you should probably be ready to be asked about that but in itself, having previously entered and left under a visa does not prevent you using the VWP subsequently.

I would agree, not an issue.

You might be asked about it, you have your answer.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
