K-1, Canadian Citizenship

Timeline

Hello:

I am a Canadian Permanent Resident whose Canadian Citizenship is under process. My fiancee is a US citizen. Previously he was planning on moving to Canada with me. He applied for several jobs and even interviewed and everything seemed to be moving in a good direction until his father expired. He was forced to stay there with his mom in the US and now are considering my options for moving to the US. K-1 seems to be one of the ways, however, I am not sure if it would affect my Canadian citizenship which is still under process.

Any knowledge in this matter would be appreciated!

K-1 is a NON-Resident fiancee visa it should not affect citizenship process for a different country.

More than likely you will be a Canadian before USCIS even gets around approving the I-129F.

The I-129F asks what is country of citizenship, which at the moment is not Canada.

Hopefully, you will be approved for your Canadian citizenship before you need to move to the U.S. because I am pretty sure you can only be out of Canada for a certain number of days per year in order to remain a permanent resident, and eventually get your citizenship.

Someone else who knows more about the Canadian immigration process may give you some clear advice here.

SHOULD not affect you BUT if you leave Canada before it is approved, I cannot say for sure. we have some good Canadian posters here that can probably comment. As you have stated, and YuandDan said, you must list your country of citizenship on the I-129f. If you are a resident of Canada, you can have your interview there.

It would be best to have your Canadian PR status first, once you do you only need to be present in Canada for two out of every five years.

This would give you enough time to finalize your status in the US, a better option might be to marry first and then do paperwork as it will be at least a year where the K1 can be approved in a matter of months.

Keeping your permanent resident status

Your permanent resident status allows you to live in Canada, but there is also a time limit on how long you can live outside the country. To keep your status as a permanent resident, you must live in Canada for at least two years within a five-year period.

the poster is already a PR, applying for citizenship. The only problem I see is that if you are out of Canada when they schedule your test (for example, you are waiting on your AP documents and cannot leave the states) then after 2 attempts they abandon your file and you will have to start all over. You will still have to meet the 1095 days out of the last 4 years to qualify to apply again and you will have to again pay the payment from a Canadian bank. Other than those concerns, getting your citizenship shouldnt be a concern at all as it is a non-immigrant visa and the PR for Canada just has a time frame that you cannot be outside Canada, whereas some if you apply for residency in another country you can forfeit it. I definately suggest reading through http://www.cic.gc.ca/english/index.asp if you have any other questions.
