Crossing the border with a Visa pending...

Hey all... thought I would just give you my input to crossing the border with a visa pending. We're still in the early stages -- waiting for our I-130 to be approved but nonetheless... I was a little stressed.

So, I brought all my ties to Canada letters with me... and crossed the border with no problem -- didn't even need them. The boarder guard asked my two questions, I was honest and off I went.

I do suspect though, that in the later stages this might be harder so, I plan to always travel with my letters of ties to Canada while I need them.

So, just wanted to give you all some feedback as to how that went as I know I was super stressed out before the actual trip to see my husband.

NOA #2: Approval June 25th, 2009 - 92 days

NVC

July 8, 2009 to August 10, 2009 - 28 days

Interview Assigned - December 3, 2009 - FINALLY!!

Medical - December 14, 2009 - Passed

Embassy/Interview - January 26, 2010 Montreal, Quebec Canada - 167 days PASSED!!!

Port of Entry - February 26, 2010 Baltimore International, Maryland

USCIS -- ROC package sent off

November 26, 2011 to Vermont station November 30, 2011 received NOA1December 16, 2011 received biometrics appointment.

January 04, 2012 Biometrics

September 2, 2012, RFE Received.

September 22, 2012 RFE responded to

October 15, 2012 ROC approved, 10 Green card on its way.

I never had a problem, and they never once asked to see any of my evidence!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Yes, it is good to be prepared when you get to the border. If you don't need your evidence, great - but if you do need it and don't have it, well, you will be kicking yourself instead of enjoying a visit with your loved one. Glad you had an easy time.

Yes, it is good to be prepared when you get to the border. If you don't need your evidence, great - but if you do need it and don't have it, well, you will be kicking yourself instead of enjoying a visit with your loved one. Glad you had an easy time.

No problem all, I was so relieved-- I had to keep telling myself that I wasn't/would never do anything wrong.

I always have a letter from the shop owner stating I work there, etc..., my rental agreement & a few copies of pay cheques.

Since being engaged, I tell the officer I am "visiting my fiance". Never asked for any ties. I did get asked once "where will you two be moving to when you get married"...I said Michigan. He said "have you filed for the visa" I said Yes. Then he told me to have a nice day.

8/2/2021:  Mailed N-400

8/4/2021: N-400 received

8/6/2021:  Biometrics to be reused
3/15/2022:  Interview (successful)

So far, I saw no major differences crossing before or after the papers. I did cross once with my parents and that was the easiest... they didn't was many questions and I don't think I had the opportunity to even say I was visiting my husband; they did see my passport though. I'm trying to go for a visit next week :)

I flew out of Toronto's Pearson International. Oh and FYI when asked I said I was on a holiday but I was prepared to extrapolate from there-- didn't need to though.

Will keep you all posted as the visa journey moves along.

Heck, even before we filed for my K1, I was so concerned that they'd raise a brow at my "USC Boyfriend" that I brought a whole stack of paperwork with me, just in case. Makes it easier now, I can simply look back at what I brought with me at the time, get updated information to take with me, and be on my way!

Hm, I brought a letter from my employer, recent pay stubs, my schedule upon return, a bank statement, bus itinerary (used to simply get across the border) for both there and back, flight for there and back... now I'll just add our NOA1.

But I was like you, better to be over prepared than lacking and turned away.

01/08/2010 - Applied for SSN in maiden name.

01/09/2010 - Married! Officially a Missis.

01/19/2010 - Received SSN in mail.

02/10/2010 - Sent I-485/I-131/I-765 to Chicago.

02/19/2010 - NOA dates for all applications.

02/22/2010 - Received NOAs in mail.

02/23/2010 - Applied for SSN for married name.

03/04/2010 - Applied for Florida DL in married name.

03/09/2010 - Biometrics appointment.

04/18/2010 - AP received.

04/23/2010 - EAD approved.

04/27/2010 - AOS Interview at Orlando USCIS (decision pending).

04/28/2010 - Card production ordered!

05/03/2010 - EAD received.

05/03/2010 - Welcome letter received.

05/28/2010 - Green Card received in mail.

01/26/2012 - Mailed RoC packet to VSC.

01/30/2012 - NOA date on application.

02/01/2012 - Cheque cashed.

02/05/2012 - Received NOA in mail.

There have been members on here that by having that evidence has saved their butts at POE! So take some time, gather it and take it with you.

Just a heads up, I actually once had a border guard tell me that travel into the US is "flat out prohibited for any people who have visas pending". I knew that was not true, both from people on here and because I’d traveled before while the visa was pending with no problems. Having a huge stack of paperwork is what saved me. They went through it all, and asked a million questions before finally letting me go. They attached a form to my passport that I had to return upon leaving the US. So you really never know. If I hadn’t known any differently, I wouldn’t have gotten in to see my fiancé.

Jan 30, 2009: I-129 NOA2

Mar 23, 2009: Package 3 logged at Mtl. consulate

Jul 15, 2009: Interview

Jul 26, 2009: Moving day!!!!!

Aug 24, 2009: Wedding
