You need to inform USCIS of this marital status change, and may be required to refile the I-751 if the divorce is final before the I-751 is approved.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

Which service center did you file it to? VSC or CSC? If it's CSC, they may already be working on your case. From what I've read on this board, you have to withdraw their jointly petitioned file then replace it with a new one as waiver filer. But you have to get a divorce before you can do this and you need to send the divorce decree with your application. Waiver filers are usually called in for interviews or get RFEs, and the wait seems to be longer compared to joint filers. As long as you can prove that you entered the marraige in good faith, and a divorce decree it should not affect your approval, it's just a bit tougher than the process for joint filers.

Good luck and let us know how it goes.

I was in the same situation, and I was recently approved. I had an RFE where I both sent the requested information and notified about my pending divorce, and I had an interview, where I brought my divorce papers and was approved. The IO told me that the rules were recently changed, you can be approved under these new rules if you filed jointly but divorce was final before the day of your interview.

Also I have read that if your divorce is not final yet, and your spouse is willing to cooperate, you also can be approved.
