I was wondering, after we receive the NOA 2, is there a certain amount of time they give you from the NOA 2 to the scheduling of the interview? I mean does the NOA 2 expire if you wait too long to schedule the medical and other interview?

The reason i ask is that my finacee wants to get a job soon in Cebu while she waits for the NOA 2. She says that at the call centers where she applied they make the employees sign a 5 month contract. She says that if she breeches the employment contract that they will charge her 45,000P.

So we are trying to figure out if there would be enough time to fulfill her employment contract AFTER we receive the NOA 2.

I am also curious as to how serious these employment contracts actually are. Would a call center really try and sue a poor filipina for 45,000P? And could a breech of such a contract hinder the whole K1 visa process in some way?

Any info is appreciated......thanks.

  • The NOA2/Approval Notice does expire (4 months from date of issue) but you should not worry about this expiration date.
  • Once the interview takes place and the visa is issued, she will have 6 months to enter the US before the Visa expires. So you'll have plenty of time.

call centers in ph nowadays do that, its common. but dont worry too much about it. Im about to start mine tomorrow (we have the same contract) and my visa interview is in 16 days. If she's leaving the country anyway why worry? all they can do is not give her a clearance from work which she will need if she applies for another job in the philippines and not release her backpay. that's all. the company wont really spend time and money to sue every single employee who resigns. I know some friends from call centers who had resigned as they have better job offers in other companies, they just cant include their previous employer in their resume bec. they know that they wont be able to get a clearance or cert. of employment anyway. that's all. so, go do what you have to do and even if she have the visa, she still have six months in her hands :)

Is your fiance scared she will be sued for not fulfilling her contract.

Tell her to tell her company to "Pack Sand"

It will have no bearing on the K1 Visa Process.

Nor would I worry about it personally.

It just goes to show how much control / power authority figures have in PI.

maset09 is right! i've worked in the call center before. I signed a 6 months contract, resigned in two months, formally offered my resignation letter and everything went fine.. your fiancee has to explain her situation somehow, they will understand.

I would tell them to take their job and shove it

^I don't think she needs to get all "badass" on them, but i do think the whole contract thing carrying a fine is pretty ridiculous. I guess she will just work as long as possible and then explain the situation, resign, and forget about it....but hopefully they don't want to pursue the matter, because that will just stress her out more.
