Question about social security number once in usa

Hi, my hubby has just entered the usa three days ago on a k3 visa received from london. Question is when does he get his ss number and when can he work? He needs to work asap as we need the $$s. Any advice is appreciated. thanks!

A K-3 has no employment authorization and must apply for it once in the US (see form I-765). Once the EAD/Employment Authorization Document is issued, he can apply for a Social Security number. Considering the time to apply for an EAD and receive a SS#, your husband should plan on not working in the US for about 4+ months from application.

Hiya thanks for fast reply but he applied already when he went to london they said that he just needed to wait for the ss card in the mail when he got here. We do not need to fill out anything as he did this already before we got here. just wondering how long this will take to get his card.

Only if he came on a CR1/IR1 will he get a SSN staright away........K3 he has to apply for EAD first :yes:

April/04/2005- Visa journey began!!

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

Mailed I-751 April 12th 2008

signed for @ NSC April 16th

NOA date April 16th

Conditional GC expired May 5th 2008

Biometrics Detroit May 10th 2008

10 year Green card ordered August 20th 2008

Citizenship any time from feb 2009

If he applied as a part of his K-3 application, that will not generate a Social Security number no matter what the Consulate told you.

If he applied as a part of his immigrant visa (CR-1) application, the card should be mailed to him within 3 weeks of arriving. He will also already be work authorized and will not need the EAD.

Confirm what visa your husband has.

Answer "Yes" to Questions 33a. and 33b.on Form DS-230

If he checked off on the DS-230 that he wanted to be assigned an SSN he will then need to allow at least 3 weeks to see if the Enumeration At Entry process works. If he doesn't receive his SSN card within 3

weeks, it's time to head on down to your friendly neighborhood SSA office.

If he has been assigned an SSN the office can provide him with the

number. However, it is has been over 14 days from the day the SSN was

assigned and he hasn't received the card he will probably need to

apply for a replacement card.

Take proof of age, identity and work authorized alien status. Proof of age is not needed for a replacement card.

Birth certificate, passport and I-551 card or passort and MRIV with temporary I-551 language should be enough to take into the SSA office.

check SAVE again (2) ask if they sent a G-845 (3) if yes, did it come

back (4) after 30 days ask if they have followed up on the G-845 by

calling or sending another mark "second request."

“second request.”) If the DHS response is still not received within 15

federal work days after the follow-up contact (if the follow-up is by

mail allow five additional federal work days of mail time for the G-845

to be received at and returned from DHS), make a second follow-up

contact. If the DHS response is not received within 15 federal workdays

(again, if the follow-up is by mail, allow five additional federal work

days of mail time for the G-845 to be received at and returned from

DHS), after two follow-ups, contact the RO. Also report to the RO any

trend that shows a serious deviation by DHS from the above time frames.

I recommend you get this form in asap, so you get the work permit asap. They say it will day 90 days or less to get the work permit, but it depends on how fast your part of the country is. But the cool thing is, once you get your receipt back if you don't get the work permit in 90 days of that, you take the receipt and make an appointment at your local immigration office and they will give you a temporary work permit until they get the work permit process. So in short your spouse will be working in about 90 days or less. The bad news if you can't get your social security card until you get your work permit. We went earlier and found that out and were told to give them a week or two after we got the work permit to give it time for the information to get in their computer records. Well we couldn't wait, we went the next day. Of course my husbands work permit records was not in the system and it took a month to get the social security card, a lot longer than it normally would if they had records. So just be patient this is how it works. Also keep working on your I130 for the greencard and that will hopefully get processed in good time also.

I know you need the money, but keep costs low and let your spouse time to get used to living in the US. Your spouse will be working soon enough.

Your husband is 'done' with immigration for the near-term. He is now a Permanent Resident and his Green Card and Social Security card should be mailed to him within 3-4 weeks of entry. He should NOT apply for a work permit/EAD. He is NOT a K-3.

"The foreign spouse enters the US, and at the port of entry will have their MRIV endorsed with a stamp. That is now proof of the immigrant’s new status: Permanent Resident. It is adequate evidence for most purposes and is equal to the I-551card that will be mailed to them, also known as the Green Card.

The foreign spouse receives immediate work and travel authorization from the “green card stamp”, and will only need their social security card before starting to work. You may have already applied for this on the visa application DS-230 II. If you have applied for the Social Security number via the visa application, your SS Card s mailed to you separately within a month. Your Green Card will be mailed to you in the same time frame.If you haven’t received anything within a month, it’s time for follow up.

Note: If you have been married for less than 2 years when you enter the US, your Permanent Resident status has “conditions”. A CR-1 PR is no less a PR than anyone else, but they do have an additional step to take 2 years after they enter the US. Please see the Guides for Removal of Conditions (form I-751).

Sorry I didn't read later messages that your husband was a IR-1. The last person is correct you should receive it all in the mail. I hope it comes soon. What I told you earlier ignore because that was for a K3, I misunderstood what you got.

I know of a dozen people who never got this, despite putting it on the DS-230, and all had to go to SS office to apply. I have not heard of one person actually getting the card.

Someone explained to me that since the DS-230 is used for various visa types, this box is only relevant to certain types, but not familiy based visas... I'd love to hear that this comment is wrong...

Only people age 18 or older that apply for an immigrant visa are eligible and all K visa classifications are nonimmigrant.

When an individual indicates on the DS0-230 that he or she would like to be assigned an SSN when applying for an immigrant visa, one of three things may happen:

1. The application information is not transmitted correctly from the

Department of Homeland Security (DHS) and Department of State (DOS)

and the individual must go into a Social Security office to submit

an SSN application (Form SS-5).

2. The application information partially transmits from DHS and

DOS and the individual must go into a Social Security office. If

the exception can be corrected the SSN can be assign and card

issued. Otherwise, the individual must submit an SSN application.

3. The application information transmits correctly from DHS and DOS and

the individual is assigned an SSN and the card is mailed to address

provided to DHS for the mailing of the I-551 card.

oh, always meant to add to this..

Plenty of people do get their SS#s this way.

But complaining posts are more common than victory posts. It's just a Social Security card after all. ;)
