I have a pending I130 that i received the NOA1 on April 2, 2009. I originally didn't plan to file for a K3 non imm visa. Lately, I've noticed that quite a few people's I130 and I129f were approved on the same day, even when the I129f was sent up to a month after the I130. I've also seen where if they approve an I130 before they realize the I129F is there that it will be denied. Advice?

Your choice but sending i-129f might delay your process because it will give your case a new NOA-1 date. A lot of people suffered that last year, so choose wisely.

My advice go for the CR1 Visa. The process is moving quite fast for it now. With the I-129 you have to change your status again when you arrive in the US. You have to go through INS once again. So choose wisely..Good Luck

Mine were both approved on the same day. K3 used to be to used to speed up the process, and now it's about the same wait time as the CR1. Most people file both, and then dump the K3 later on throughout the process. I had a friend who filed both and was schedule a K3 interview 3 weeks earlier than her CR1, so she went with the CR1 because of the automatic green card, and it was cheaper! :)

Good luck!
