DENIAL NOTICE... TOO SAD!!!!

hi please help me...we been waiting for our case approval...almost 4 years of waiting and nothings happen... we did everything to accelerate the processing,, we call regularly at uscis,,my husband apply for N400, upgraded our case, sent RFE...my world now is crashing i feel like dying, i want to cry and shout to ease the burden i have right now. today i got email from USCIS..DENIAL NOTICE... i feel like a child who left by mother,,,im crying and i dont know what to do...after all the long and patiently waiting the result is DENIAL...how painful it is friend. Please help me what to do.

my husband filled petition when he was LPR.. oct. 2005

then feb. 09 RFE from USCIS evidence for green card holder.

march 19 09 his oath taking...

march 20 he sent back the RFE ENCLOSED WITH THE naturalization cert. with letter upgrade.

this may,,he notice that he didnt fill out the form g325a which include for the rfe...so he download that forM, filled up and sent it to USCIS WITH ATTN: ADDRESS AT USCIS.

WE ALSO CALLED USCIS FOR THE UPGRADING PETITION AND THEY SENT US LETTER THAT OUR CASE HAS BEEN UPGRADED...NO NOA2..

and now we received notice of denial...my husband had his high blood pressure when he read that notice,,,after all long waited time the result is denied??? we are 4 years married,,,were neighbor,,,have 19 years of age gap. we are newlywed when we part our way...never had a chance to have child because of the limited time,, lots of burden,,,depression,,,lost hope,,,

i think that another conflict is the subpoena...he had accident when he was working BTW he laid off,,, about nov. 09 nahold up sya. 2 mexican took the money...almost 13 thousand dollar.. and one mexican beat him at his head so what he did is defend for himself and for the money of his company, police came in when the holdapper already laid,,another was left with the 13 k

I am sorry to hear about the denial. But the only recourse is to file an appeal. But on what grounds did they deny the I-130? The only way the deny the I-130 at this stage is because you lack the evidence neccesarry to continue on, or they suspect a fraudulent petition. I do believe the appeal process is very time consuming and expensive. Just to file the appeal form it cost $585 USD to file and a decision can take months to years. I am on the second go around with my wife, she got denied at the visa interview so I can understand on how devastating this is. I would seek legal advise from a immigration lawyer. Based on my experience from the immigration process, once the deny the petition, you have the choice to appeal to a higher authority, but if there decision is up held, it is final. And unfortunatley the same result will happen again, if you refile. Please seek legal advise as soon as possible. :thumbs:

Denial for I-130 is taken when theres a very strong reason for such Denial

please go through the Denial Letter ...they state why the Denial occured

may be they lost any papers that u sent to them and issued an RFE tht u didnt recieve ..so they denied it (thts a reason for instance )

so check why u r denied

and if it was their mistake u have the right to refile with expediting request also ..

im so sorry for this

(i agree - most likely they didn't get the RFE response)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

How many days was there between RFE in Feb. 09 and March 20 (must be USCIS received date)? USCIS must receive your response for the RFE no later than the specified time frame, otherwise a denial is almost likely. too bad you have to face it, hope you can get through it, and soon.

did you get any lawyer to help you before? Did you also do a lawsuit too (just like me?).. that usually scares them, but it's good to have a lawyer as backup.. what does the denial say on the letter? do some research on appeals (and you probably could file an appeal lawsuit too, not sure of that).. We didn't wait as long as you (but considering I am US Citizen already, it is long enough), but we may be going down the same path..

She hasn't got the letter yet, re-read her post. She received an email update that her case was denied and a letter would be sent with the reason within 15 days.

I'm so sorry. As soon as you get the letter and learn the exact reason for the denial, contact a lawyer and find out what options are available for you.

Hope you can sort things out soon.
