Hello Everyone,

I wrote a similar update here and on the K-3 forum, please forgive me if it's double talk, I wanted to post this update to the Africa forum to get your very specific suggestion.

Everyone here kept telling me to call NVC and USCIS. I didn't think there was more information but I called again this time not about the denied I-129 but the I-130....

I found out that NVC has absolutely NO record of our approved I-130 petition.

Does that make sense? No, it doesn't since I just got a uscis letter stating that NVC sent my I-130 For review.

However, it does make sense for us because we never received any paperwork on it.

I kept writing here over and over that I didn't understand how they could review a visa that is not interviewed for.

I had some write that it was attached to my I-129, which is what I was thought but I kept going back to that point.

USCIS said they sent approval to NVC back before March of 2008.

I dug through my papers because the lawyer I had at the time spent 2 months asking where both of our approved petitions were at NVC.

After about 6 weeks After approval was sent to NVC, they sent the I-129 notice.

I don't think the lawyer realized our I-130 did not exist at NVC because we got some strange letter in Spanish and after that were onto another weird crisis in paperwork.

I am trying to piece this all together. Should our lawyer have seen this before? I know the lawyer did not receive a package from NVC, I did not either, and they have no record of it.

Do you have any more suggestions?

Afrilaskan, no one can give you the answer you are looking for here, because on ALL of your pots, the situations and time lines don't add up. So to help everyone and to keep all of the details in one place could you please only post your situation in one area. Second, you need to make a tmeline , very detailed timeline of the events that have taken place regarding your entire situations so that all of the pieces can be viewed together. Third, we will need to know all of the reasons why your husband was denied, I know it maybe hard to share some of the details but unless everything is stated it is hard to piece together why this has happen, The timeline will enable us to guaze what happen at what time in this process. The denials reasons will assist in telling you exactly how to resolve this situation. The reasons why I am saying everything has not been posted is because you stated in a previous post that there were some things you didn't want to share at that time, this was after you had spoken to Marc Ellis.

If you are working with a lawyer, this will become de-constructed, because you will have many people telling you different things to do to resolve this bad problem. I know you are feeling loss right now, but take the time to put everything on a time-line, and tell what event took place, and how you resolved them.

i.e lawyer filed I-130 on mmddyy

recvd NOA2 for I-130 on mmddyy from uscis

NVC sent notice of receiving I-130 on mmddyy

Be as detailed as possible, and I think you will see where some of the pitfalls and mistakes happen.

Take a deep breath and start this small process to get to the end.

I know that this is upsetting for you to be going around in circles and I am sorry for your pain. However, as has been advised many times by many people here, you need to not just call and accept right away what is said to you but you need to demand to speak to a SUPERVISOR. When you call these call centers you are just going to reach people who read from a script. If you get past that person then the next level of "customer service" person is going to be in a hurry to get you off the phone so they can go back to what they were doing or so they can get to the next caller. You need to be polite but very firm and demand a supervisor because they are able to take the time to find out what happened. You need to take the name and ID of each person you speak to and when you reach the supervisor you tell him/her who you were speaking with and ask the SUPERVISOR to confirm what the person has told you. Also when you find out what happened you need to demand they put into writing an explaination of what happened and mail it to you. At the beginning of your call and with each person you speak to notify them that you are recording the phone conversation. When you do these things with any business or agency they tend to get on the ball and get the knowledgable people on the phone with you because what you are doing is giving them a whiff of impending legal action. I am willing to bet that your lawyer was not calling and trying to get to a level where he/she could get any solid answers about your case, especially if you were not paying them top dollar. So the suggestion is that you backtrack and call at every level and do what I've mentioned here at each level. USCIS, whichever service center you filed at, NVC, and the consulate. If you have to demand that the supervisor call the next step. Have the supervisor at the service center call NVC and have them keep you on the line so you hear what is said. They are also the ones to ask about what your options might be, although they are not going to give you any legal advice they can best tell you the rules of the game and whether you can refile the i130 or what steps are available to you. Stop waisting time speaking with lower level worker bees! 2 years have passed already.

These are steps to take not just in this process but in any process where a company or agency is giving you the run around. It tends to work. You can't be afraid to demand something in writing or tell them you are recording the conversation. You have to be firm in doing this. Don't pass it off to an attorney to do. YOU need to do it and be angry when doing it. I know you say you don't want to call out of emotion but even when armed with the law and a few facts you need to have some passion in your voice and make a firm demand otherwise no one is going to move towards doing what you need. Just keep in mind that attorneys and even the senator is also working on other things. You have to be the one calling and demanding info every day until they get tired of you and find out for you what is going on so they can get you to stop calling................That is just how it is.
