I-129f Birthday error! Could you help me please?

I am in NY, USA, and applying for my fiancee in china to come over using I-129f form.

The vermont service center received my case on 12/23/2008. I received 1st NOA, then i found that I filled in my fiancee's birthday on i-129f form wrong! I put in 07/05, but the actual date was 07/19. It was because for some reason she celebrates her birthday on 07/05 but has 07/19 as official birthday on her legal documents. Anyway, I sent a letter to the Vermount center addressing this issue, but I didn't follow up on the letter(sigh....).

On 04/16/09, I received my 2nd NOA, and in a few weeks my fiancee received her package for visa application in china, and the package said her birthday was 07/05! We are so worried about this problem we don't know what to do, could anybody give any advices please? Thanks in advance!

I don't think it will be a big issue.

Make sure you have the correct date on future paperwork submitted. (as in - correct the date and place on all paperwork)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Don't worry. She can correct it at the interview. I made an error on one of our sons birthdays, we just told them at the interview and they gave us the form and we crossed it off, changed it, and initialed it. Simple as that.

However, I called USA Visa Information Service Call Center for the United States Embassy and Consulates in China (7$ / 12minutes) and asked about this, and they advised me to correct it from both the US side and the China embassy, and told me that somebody was denied at the interview because of a birthday error. I will try to contact both side and do my best :unsure:

Consulates and consular officers have huge latitude in approving or denying things. I am not saying the advice you were given is bad, only that it may not be exactly accurate. Saying "a visa was denied" for a birthday error can be a lot of things. Hmmm...was the error that when the birthdate was corrected the applicant was not old enough? Provided what you did was a "clerical" error and not something affecting the qualification for the visa, I do not imagine it would be a problem. I am not sure how you would "correct it on the US side" as your entire petition is sent to the interview. At the time of the interview, the consulate should have all the documents you have submitted to date. They did in our case.

China is an entirely different entity than other Consulates. If you were going through say New Zealand i'd also say.. no big deal. In China, however, chances are they will look for any indescretion they can find to deny the visa. If you haven't already, visit www.candleforlove.com to learn all you can.

That being said, you are at the USCIS petition stage of this process so the Embassy has nothing really to do with it until you are approved here (NOA2/I-797). You can call the USCIS and have it adjusted but be aware, even though they say the changes will be made....they very often, are not.

All you can do is be certain that all other documents are filled in correctly from here on out!

I called the uscis phone number 1-800-375-5283, and they told me that since the case is already received by National Visa Center, I should call them to change the birthday. I just sent an email to NVCINQUIRY@state.gov. I will also send a fax to GuangZhou consulate about this problem. hope everything goes well.
