I-864 or I-864EZ

hi all!!

Please help me since I am very confused. I read the instructions for AOS and I am filling out form I-864EZ. I have a steady job for past three years and my income is way above the poverty guidelines, so therfore, I am filling out I-864EZ because I am using my income from W2 only and I don't need to use assests.

The only confusing thing is Question 19 on I864EZ when it says "My total income (adjusted gross income on IRS Form 1040EZ) as reported on my Federal tax

returns for the most recent three years was:"" BUT I DID NOT FILE 1040EZ. I FILED IRS FORM 1040 AND MY ACCOUNTANT DID THAT,SO WHICH FORM IS APPROPRIATE FOR ME??? I-864 OR I864EZ??? THANKS ALL!!

Use the I- 864 and you won't have any problems. Sounds like they "may" require having filed taxes with the 1040EZ to use the I-864EZ. I wouldn't take a chance. I-864 isn't that much different anyway. You don't need to list assets if you're over poverty guidlines.

Please, continue to use the I-864EZ, find the line item that says Total Gross Income on the 1040 and use the income that is calculated there. The I-864EZ is the correct form if you are only using income to meet the requirements.

:thumbs::yes: Exactly as they say. From line "19 Federal Income Tax Information" of the instructions for the I-864EZ;

"For purposes of this affidavit, the line for gross (total) income

on IRS Forms 1040 and 1040A will be considered when

determining income. For persons filing IRS Form 1040EZ,

the line for adjusted gross income will be considered."

The line for gross (total) income on the 1040 is line 22 total income.
