Can i petition my gf from the philippines once she got her divorce paper?

hello guys i hope u can help me regarding this problem coz i really dont know whats the best thing to do. i am inlove to this girl from the philippines who just recently separated to her husband his american ex husband filing the divorce here in the US so probably in 2 mos she will recieve the divorce paper.. my question is can i petition her once she got her divorce paper? coz were plannign to get married here in Georgia and do we need to file the petition for foreign judgement that some people said to me? and also she was petition by her husband b4 but it has been withrawn already..i hope u can answer my question i need ur help so bad..

Once she receives the divorce decree from her ex-husband, you can start filing the K1 petition, if that is the route you choose to bring her here. Since the marriage will take place here in the US, after your petition has been approved, there is no need for her to file a petition before the Philippine court for the divorce decree to be acknowledged for purposes of remarriage. Be truthful in answering the questions especially about her previous petition.

She might need to go to court and have it recorded. She will need marriage index and it will show up that she's married. Consult a local Family Lawyer about this matter. It would be best to fix everything legally before you start the K1 process. Likewise, I would suggest waiting it out a bit, I meant no offense or any judgmental comment here, but if you two quickly file the k1 as soon as her marriage is dissolved.. it might be construed as a desperate act on her part to get to the US. I'm just saying.. it is true that Philippines is a high marriage fraud country... both of you don't want to go through the heartaches of getting denied, I'm sure. So best thing to do is fix the legalities, gather more 'proof' of bonafide relationship (snail mail, emails, evidence of visits and togetherness), line your ducks before filing for the k1. This is just my thinking... best to consult a local lawyer here.

Yes you can petition her once she has her divorce decree.

Hmmm expect some grilling from the embassy. Coz you have prove that you two have a bonafide relationship, and it's not for visa purposes because she has already have a record of petition from different American citizen which was just recently withdrawn. It may raise a red flag, or not. Either way just prepare well.

no specific timeframe. the fact a previous petition has been filed and withdrawn it's already a sign of possible visa fraud. If the relationship is truly bonafide then file it anytime as long as the divorce has been approved just be ready to be grilled. Good luck.

I think she never arrived US. Hmmm I don't know, it smells fishy anyway. just my opinion.
