High Risk Pregnancy - Trying To Expedite

Timeline

We have applied for IR-1/CR-1 and were just told that my Wife is at a very high risk of losing the baby, we have a Dr's letter and are hoping to expedite, though haven't received NOA1 yet.

Anyone had experience with something similar to this? I'm wondering how long we should expect it to take if expedited and whether or not a high risk pregnancy will be seen as an eligible reason to expedite? Also, is there an additional fee charged to expedite?

Baby is due early October.

You dont have NOA 1 yet???? You need to find out where NOA 1 is at, do you know what service center your case is at?

All you can do is try for expedite, there is no additional charge to request a expedite, but most expedites are life and death situations, unsually not pregnancies normal or high risk, or if military and petioner is about to deploy out. All you can do is try for expedite, you call and request a expedite, and the service center will contact you for info. if they think its a reasonable request for expedite. Good luck.

Yeah, it's been 29 days since we sent the I-130. I keep hassling my Wife to call them again.

This is what USCIS uses to consider requests like this:

Please keep in mind that expedite requests for applications and petitions will be considered based upon the following criteria:

•Severe financial loss to company or individual

•Situations of extreme emergency

•Humanitarian situation

•Department of Defense or National Interest Situation (Note: Request must come from an official U.S. Government entity, stating that delay will be detrimental to the U.S. Government.)

•USCIS error

•Of compelling interest to USCIS

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I think you guys should be able to get an expedite. Life death situation for your baby, does that not count for anything? I think it will, i have heard of people getting expedited because their parents are recovering from heart attacks and stuff, but that is RECOVERY!!! Your baby is in danger NOW!!! , i dont think you guys will have any problems, but you wont know until you call... so i suggest calling.

I know you want to reunite with your wife as soon as possible but if she is in a high risk pregnancy isn't it better for her to stay in Australia to deliver the baby where she will have access to the necessary doctors & medical treatment?

Hopefully you have a job with medical insurance which allows you to add her (and your child) as dependents to the policy but since she is already pregnant I'm not sure if it's seen as a pre-existing condition, and if they will even cover it.

I know you want to reunite with your wife as soon as possible but if she is in a high risk pregnancy isn't it better for her to stay in Australia to deliver the baby where she will have access to the necessary doctors & medical treatment?

No, I'm the Australian. We were married in Aus' in january and now she's back in Boston.

Also, as many people have noted on this site, this may be a case where you're wife can contact her U.S. Senators as well to ask them to intervene on her behalf to expedite your petition. Of course try contacting USCIS first, but also have her place a call and send a letter to her U.S. Senators. I would definitely tell her to pursue all options based on her medical circumstances.

I'll be praying for you, your wife, and your child.

My case was expedited due to pregnancy.................

we just actually wrote a letter requesting for early interview,but we found out that our case was expedited at the NVC.

we submitted all the proof and evidences,like doctors appointments,baby's ultra sound so on and so forth.......(without the help of senator,or whoever)just lucky try.

there is no extra payment for expedite case.......

but being a pregnant is not a reason for expedite.(According to NVC)

anyway there is no harm in trying............
