With the economic downfall, I lost my job and haven't been able to find another job. My question is if you are unemployed, what can you do in terms of paperwork? I'm not sure but I heard something about co-sponsor and how much you have in the bank helps. One more question, if I started the paperwork already, hence sent in the I-130 form already, can I hold and submit the rest after I find employment or do i need to resubmit everything after employment. Thanks

Are you receiving unemployment? You can count that as income. However, you must clearly show your work history before you became unemployed. What you have in the bank or other assets (stocks, etc.) can help you make up any gaps by showing 3 times your short fall. So if you are $1000 below 125% of the poverty guideline, you will need to show $3000 in assets to be okay. A co-sponsor is just as responsible for your SO as you would be as the sponsor. Both you and the sponsor must complete the sponsorship forms & provide tax transcripts.

I'm not sure of the IR1/CR1 process, I did a K1. But I would think that you would like to have the most update information for the interview. I filled out I-134 about a month before the interview. Please ask this question in your regional forum, I know some countries are more strict about financial details. Others who have gone through Vietnam may have more specific advice.

I wouldn't count on unemployment to get you through this, the embassies look at the total picture of your income situation, and unemployment is limited.

(they go out 5 years according to their FAQ when they consider the factors).

Cosponsor would be better in the long term.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You could try to drag your feet at the NVC stage (if you haven't found a job by then). You don't have to send in your sponsorship information until you submit the I-864 - which happens at the NVC stage.

That's correct. You have maybe another 3 or 4 months to look for job before your paperwork (I-864) sent to NVC. Since you are doing CR1, it's time for you to find a CO-SPONSOSHIP, if you can't find a job by than. REMEMBER, K1 or K3 visa doesn't allow sponsorship in VN country.
