travel to US from CAN during the process

Is this frowned upon to travel back and forth while waiting for approval or while the paperwork is being processed? I still have a job in Can and plan to return after visits and do not plan to go to the US and wait out the process.

I pulled this from the US immigration site:

"Entry to the U.S. while Petition is Pending

All persons traveling to the U.S. as visitors or students, Canadian or other nationality, under U.S. law are deemed to be intending immigrants and thus inadmissible for temporary purposes until they have an immigrant visa in hand. The burden of qualifying for any visa for entry to the U.S. rests solely with the applicant. Entry to the U.S. is solely up to a Department of Homeland Security/Customs and Border Protection (DHS/CBP) officer at the Port of Entry. While intending immigrants may have and lawfully seek to exercise a dual intent to be a visitor or student now and an immigrant later, it is against U.S. law to enter the U.S. as a visitor or student with the intent to wait for or seek immigrant status while in the U.S. Anyone who attempts to enter the U.S. by misrepresentation, or unlawfully, may face severe sanctions up to and including permanent ineligibility to enter the U.S.

I recently (last month) went to the US with my case pending. I had supporting documents with me to prove that I was coming back to Canada (letter from employer, proof that I still owe money on my car) and I brought with me a copy of my NOA1. As soon as I handed that to the border guard he said "This piece of paper (NOA1) is saving you LOTS of hassle". I had a few more questions than usual, but I did not have to go into secondary or anything like that.

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

Question for you all.

As I am the beneficiary, how do I obtain the NOA1? My USC husband has it??? I am going to bring a letter from both my employers, my rental agreement and copies of my banking and bills and stuff here -- do you think that'll be okay?

I don't have the NOA1 so....

I've been to the US twice since the beginning of the process and going back this weekend. Both times I was pulled for additional processing and given a B2 visa that the border people in Canada had to send back to US on my return. I was also photographed and fingerprinted the first time. I go through Champlain, NY border.

I'm still always a little nervous since I don't work (maternity leave), have 2 American citizen kids, almost all my stuff is there already (Dex had to fill out something when he brought my stuff to his house, so I'm guessing it's on the file) and sold my apt...(back with mom), but they never asked to see anything. As you can see, I'm not a very good candidate in the sense that I don't have many reasons to come back to Canada! I think that the fact that both times I came back exactly when i said I was, I guess they see, that I'll wait for the visa to move there permanently. I don't think it hurts our case to travel to the US alot....I actually think it helps in my credibility. Since we've known each other we've been traveiling back and forth at least once or twice a month, so there's no sense to stop now that we are filing for a visa. Since the beginning of the K1, Dex also comes every chance he gets so maybe they see that in their file too.

I say travel as you want, but always be prepared not to be able to enter the US...that's how I see things! Good Luck!

Yes your husband would have it, well USCIS would send it to him. I think you're fine with all that you have since NOA1 only proves that your husband filed for you, dosen't show ties to Canada like the other papers you have.

I crossed ALL the time! I would stay for 2 months (maximum at a time) sometimes only a week, etc. I always made sure I had copies of NOA's and my banking info, credit card info, student loans, etc. Anything tying me back to Canada. I was never ever asked for the information. Just be honest and tell them who you're visiting and how long you're going to be gone for. I've heard they can see things on their screen, but my friend who works on the Canadian Border side said they can't. I used to get so nervous crossing! But don't worry about it...
