Timeline

Whats up people, my question is the following, from what I have been reading in order to bring my fiance last year would have had to have made a minimum of $18,000.00 that not a problem for me, im working on them right now and well over that amount, my question is will i only have to show the my 2008 tax's or will I have to go back a couple more years? i have not filed my tax's from 2007 on back, long story, anyways anyone that has had any exp, in this please let me know what to expect so that i may start on it right now. Thank you in advance for your help

As the instructions state - Most recent tax year's return is required but you may submit more if you feel it will help [paraphrasing of course] . :thumbs:

thanks for the quick response, if thats the case i think it will be easier for me to just show them my 2008 tax's.....oh i heard this from a friend is it true that one they get you tax's the contact the IRS to see if you own them any money??

No, that's not true at all. Immigration is not concerned about whether you owe the IRS any money or not. They just want to see if you made and still make enough to support the people you're petitioning.

For the K visa I-134 you will only need to show 2008. For the AOS I-864 affidavit of support you will need to have filed all the back returns. See below from the I-864 instructions(pg 8):

If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support. If you were not required to file a Federal income tax return under U.S. taxlaw because your income was too low, attach a writtenexplanation. If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it.

For the interview, 2008 will be fine. For the AOS you must also submit statements of gross income as reported for the last three years and all tax returns must be up to date or you must submit reasons why taxes were not filed and give documentation of why you were exempt from filing. For now, you are OK, but it will have to be corrected/justified prior to AOS so you may as well get started on that.

No. If there are any tax leins against you, they will find that out and we have seen reports of visas denied due to tax leins.

As mentioned before, your tax filings must be up to date for the AOS

I've heard (read from posts here) some embassy/consulates require 3 years (if I remember correctly?) Since nobody's mentioned that, I can only assume it is not a requirement for Costa Rica (?)

You might want to verify with someone who's successfully worked with this embassy .. or contact the embassy for verfication :)

04/09/2009 -- She flies to USA for 9 day visit (6mo given on I94)

06/20/2009 -- She arrives for summer visit (6mo given on I94, warned about too frequent visits)

06/30/2009 -- NOA2

Note: petition processed thru NVC and sent to embassy in about 1 week :o

Note: got an initial interview date in Sept, but decided to put it off so she could extend her vacation here thru end of October

10/21/2009 -- She returns to Poland :(

12/01/2009 -- Embassy interview -- SUCCESS!! :)

just to make sure, I need to make a min of 18,800 dollars a year correct? i have no dependents and live alone.. also i was reading the guidelines for the AOS requirments which i finally found i i read that you only need your latest tax return, if you wish to send the past three you can, being as how i will be doing that sometime next year i can send 2009 an 2008 :D

It's $18,212 for forums submitted in 2009, unless you live in Alaska or Hawaii. You only have to submit the most recent year's tax transcript or copy of tax return. You can submit the most recent three years if you believe that will help establish sustained income.

05/01/2013 - Removal of Conditions - APPROVED!
